ORDER OF PUBLICATION
TO THE ABOVE-NAMED DEFENDANTS:
The object of this action is to QUIET TITLE to certain real property located in Center District, Wetzel County, West Virginia, more particularly described as follows:
A certain tract or parcel of land situate in Center District, Wetzel County, West Virginia bounded and described as follows:
Beginning at a stone comer to Archie McGuffie’s twelve (12) acre tract; thence with said McGuffy’s line N. 15*E. 309.7 feet to a stake; thence S. 59 1/4* E. two hundred and eighteen (218) feet to a stake; thence S. 1 1/4 * E. fifteen hundred (1500) feet to a stake in J.R. Robinson’s line; thence S. 83 ½0 W. fourteen hundred and nine (1409) feet to a stake which is five (5) feet east of a
sycamore stump; thence leaving said Robinson’s line and running north 39* E. eighteen hundred and twenty (1820) feet to the place of beginning, containing twenty-six and seventy-two hundredths (26.72) acres, more or less.
Provided, however, said parties of the first part do reserve and except from this conveyance all the coal and other minerals underlying said land, together with all mining rights and privileges necessary and useful in the mining, removing and manufacturing of said coal and other minerals including the right of mining the same without leaving any support for the overlying
strata add without liability for any injury that may result to the surface from the breaking of said strata, the right of ventilation and drainage and of access to the mines for men and material, also the right of mining, ventilating draining and transporting coal and other minerals from other lands through the mines in and upon said land and generally freed and discharged from all servitude
whatever to the overlying land and everything therein and with the right to the owners of the said coal and
other minerals, or their assigns, to purchase at any time any number of acres of said surface land for any
purpose in connection with the mining of the said coal and other minerals by paying therefor such price in
connection with the mining of the said coal and other minerals as shall be agreed upon between the owners of said land and the owners of said coal and other minerals at the time said land is taken and upon the payment of such price the owner or owners of said land are to execute a deed in fee simple for the land so taken as provided for. And the said parties of the first part do moreover serve and except from said conveyance all the oil and gas underlying said tract, with the right to enter thereon at all times for the purpose of drilling and operating for same. And the said parties of the first part do make said conveyance to said party of the second part in gross and not by the acre, and the said B. Walker Peterson and Mannie M. Peterson, his wife, covenant with the said party of the second part, that they will
warrant specifically the property hereby conveyed.
Any person named above or any person who has an
interest in this proceeding must appear and defend within thirty (30) days of the first publication of this
ORDER; otherwise, a judgment by default will be
