NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 20th day of May 2014, signed by Robert B. Halstead, a married man, to Douglas B. Ernest and Charles J. Mildren, Trustee(s), which said deed of trust is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4031, at page 291, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 11:15 o’clock A.M. on the 26th day of OCTOBER 2020 at the front doors of the Courthouse in Kanawha County in Charleston, West Virginia the following described real estate: All of those certain lots or parcels of real estate, together with the improvement thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, and being all of Lots No. One Hundred Five (105), One Hundred Six (106) and One Hundred Seven (107) in the Hillsdale Addition to the City of Charleston, as shown upon the map of said addition, on file in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, said Lots No. One Hundred Five (105), One Hundred Six (106) having been conveyed to W.C. Halstead and Katheryne E. Haltead, his wife, as joint tenants with right of survivorship by James Gail Powell and Opal A. Powell, his wife, by deed dated the 5th day of April 1945 and of record in the aforesaid Clerks Office in Deed Book 696 at page 461, and said Lot One Hundred Seven (107) having been conveyed to W.C. Halstead and Katheryne Halstead, his wife, as joint tenants with right of survivorship, by Patton & Meadow, Inc., a corporation, by deed dated the 1st day of February, 1946 and of record in said Clerk’s Office in Deed Book 728 at Page 200, the said W.C. Halstead having died testate September 13, 1995, and the said Katheryne E. Halstead, having died August 24, 1998 by her Last Will and Testament, of record in the aforesaid Clerk’s Office in Will Book 632 at page 490, having devised all her property equally unto Thomas Halstead, John Halstead and Robert Halstead, reference to said map, deeds, and will is hereby made for a more particular description of the property hereby conveyed. EXCEPTING AND RESERVING the westerly 10′ of Lot 107 which was conveyed unto Louie Mullins and Audrey Mullins, by deed dated May 14, 1953, and recorded in the aforesaid Clerk’s Office in Deed Book 1046 at page 321. EXCEPTING AND RESERVING a part of Lot 105, which was conveyed unto Christopher K. Pack and Amy G. Pack, by deed dated July 26, 2010 and recorded in the aforesaid Clerk’s Office in Deed Book 1046 at page 321. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 2031 Hudson Street, Charleston, West Virginia 25302 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
