Runyan, Cecil H. Brock, Donna Toppins aka Donna Toppings, Elizabeth Bauer, Frontier West Virginia, Inc., Unknown Persons/Owners, and Gary Linville, Sheriff of Lincoln County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Lincoln County, West Virginia, and is known as Civil Action No. 20-C-50, and styled AEP West Virginia Transmission Company, Inc. vs. Judy Machelle Workman, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of AEP West Virginia Transmission Company, Inc. situate on the waters of Limestone Branch in Harts Creek District, Lincoln County, West Virginia, identified as Tax Map 27, Parcel 28, and recorded in the office of the Clerk of the County Commission of Lincoln County, West Virginia, in Deed Book 317, at page 69, and being more specifically bounded and described as follows: 25 AC LIMESTONE CREEK Beginning at a beech at Marsh Fork, a tributary of Limestone Creek; thence with a straight line in a southerly direction to a stake to a stake on top of the hill to lines of Albert Bell; thence with the line of Albert Bell along the top of the ridge to a stake; thence in a northerly direction straight down the hill to the said Marsh Fork Branch, to stake; thence down the branch to near the Cleve Prichard house; thence across the field so as to leave a twelve foot road between the said Prichard and the line of the road; thence with the road and the branch to the beginning, containing twenty-five (25) acres, more or less. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Lincoln County Circuit Clerk’s office at 8000 Court Avenue, Hamlin, West Virginia, 25523, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for AEP West Virginia Transmission Company, Inc., Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on November 24, 2020, at 10:45 a.m., in the Circuit Court of Lincoln County, West Virginia, located at 8000 Court Avenue, Hamlin, West Virginia, 25523, before the Honorable Jay M. Hoke. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
