TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 13, 2010, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 854, at Page 100, Eric W. Smallman and Samantha Smallman did convey unto Curt Salvador, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

December 10, 2020, at 2:30 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley District, Fayette County, West Virginia, and more particularly described as follows:

That certain lot or parcel of real estate situate in the Village of Boomer, Valley District, Fayette County, West Virginia, and being more particularly bounded and described as follows:

BEGINNING at a chain line fence corner post on the southern right of way of Park Road and being 80.02 feet east from Maple Street; thence N. 76-25 E., 60.43 feet with he right of way of said Park Road to another chain link fence corner post; thence, S. 19-51 E., 74.72 feet with the said fence and the line of Lot 225A to a post on the back line chain link fence; thence, S. 70-09 W., 60.0 feet with a chain link fence and the line of Lot 223 to an intersection post on the chain link fence; thence, N. 19-51 W. 81.31 feet with the chain link fence and the lines of Lots 222 and Lots 221 to the point of beginning, containing 4,680 square feet, more or less, and being Lot No. Two Hundred Twenty-Five (225) as shown on a map filed in the County Court Clerk’s Office of said county on the 23rd day of September, 1955, in Map Book 14, at Pages 9 and 10 and designated “Map Showing Boomer Addition, Section Three, Elector Metallurgical Company, Falls District, Fayette County, W.Va., EBL-103” and dated August 28, 1955, reference to which map is here made for further description of said lot of land.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 225 Park Road, Boomer, WV 25031.

AND BEING the same real estate which was conveyed to Eric W. Smallman and Samantha Smallman, by Deed dated January 13, 2010, from Michael J. Kincaid and Litty S. Kincaid, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book, 655 at Page 274.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
