Notice is hereby given that the undersigned Trustee will sell at public auction to the highest bidder on:
January 5, 2021, at
10:00 a.m.
at the front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia, that certain property conveyed by John Lloyd Johnson to H. Brann Altmeyer, Trustee, by Deed of Trust dated June 23, 2014, and recorded in the office of the said Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1486, at page 32, and being described as follows:
The following lot or parcel of land situate on the southerly side of Cherry Hill Road, Richland District, Ohio County, West Virginia and being more particularly bounded and descried as follows:
Beginning at an iron pin found in the southeasterly line of said Cherry Hill Road at the northwesterly corner of the 617/1000 acre parcel of land that was conveyed to Chad J. Kyle, et ux., by Deed recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia in Deed Book 662, in Page 483; thence from said beginning point and with the southeasterly line of said road the following five (5) bearings and distances: N. 28* 39′ E. 52 03/100 feet to a point; thence N. 33* 59′ E. 98 and 59/100 feet to a point; thence N. 39* 49′ E. 90 and 31/100 feet to a point; thence N. 45* 30′ E. 99 and 14/100 feet to a point; thence N. 47* 00′ E. 297 and 3/10 feet to a point in the centerline of a fifteen (15) feet wide drive, hereinafter mentioned; thence with the centerline of said drive S. 42* 34′ 06″ E. (At 4 and 07/100 feet passing a PK nail set, and a 79 and 94/100 feet passing an iron pin found 81 and 64/100 feet to a point in the northwesterly line of said drive; thence with same the following nine (9) bearings and distances: S. 01* 36′ 15″ W. 9 and 18/100 to a point; thence S. 28* 55′ 44″ W. 8 and 98/100 feet to a point; thence S. 49* 21′ 07″ W. 82 and 65/100 feet to a point; thence S. 44* 43′ 22″ W. 62 and 46/100 feet to a point; thence S. 41* 15′ 10″ W. 46 and 13/100 feet to a point; thence S. 41* 15′ 10″ W. 46 and 13/100 feet to a point; thence S. 37* 57′ 55″ W. 90 and 02/100 feet to a point; thence S. 33* 32′ 55″ W. 47 and 39/100 feet to a point; thence S. 27* 45′ 29″ W. 60 and 81/100 feet to a point; thence S. 23* 13′ 52″ W. 176 and 3/10 feet to a point; thence leaving said drive N. 67* 12′ W. (At 2 and 76/100 feet passing an iron pin found at the northeasterly corner of the 403/1000 acre parcel of land that was conveyed to Gary E. Burtrand, et ux., by Deed recorded in said County Clerk’s office in Deed Book 662, at Page 150, and at 102 and 27/100 feet passing the division line between said 493/1000 acre parcel and the aforesaid 617/1000 acre parcel) 173 and 72/100 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors on March 16, 2004 One and Sixty-Six One Hundredths (1/66/100), more or less.

Being the same property conveyed to John Lloyd Johnson by Lloyd E. Johnson, Jr. and Betty Lou Johnson, by Deed dated May 4, 2004, and recorded in Ohio County Deed Book 750, at page 446. The said John Lloyd Johnson conveyed the subject property to John Lloyd Johnson and Sheila Johnson, husband and wife, by Deed dated August 12, 2004, and recorded in Ohio County Deed Book 754, at page 389. The said John Lloyd Johnson and Sheila Johnson conveyed the subject property to John Lloyd Johnson by Deed dated April 3, 2014, and recorded in Ohio County Deed Book 870, at page 73.
The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
