The purpose of this Notice is to inform the above-named
surface owners, Albert and Brenda Reynolds, that
Marion County Coal Resources, Inc., intend to
commence work on the surface of their property located
in Church District, Wetzel County, West Virginia,
described as Map 12, parcel 43, to plug and abandon
the well known as API 47-103-03318 (the “Well”).
Consolidation Coal Company is the operator of the well.
Said work will commence as soon as 20 days following
the first publication of this Notice.
Marion County Coal Resources, Inc., is an “interested
party” as defined in the West Virginia Abandoned Well
Act (“the Act”), W. Va. Code § 22-10-1, et seq. Marion
County Coal Resources, Inc., and/or Consolidation Coal
Company have attempted to provide notice to Albert
and Brenda Reynolds, via certified mail and personal
process server at the addresses listed above, of their
intention to enter onto the premises to plug the Well.
Marion County Coal Resources, Inc., does not elect to
take any casing, equipment or other salvage which may
result from the plugging of the Well. If the surface
owners wish to take the casing, equipment or salvage,
they must send notice to the interested party at the
address listed below. The interested party will dispose
of the salvage if no election is made.
In the event that damage or disturbance occurs as a
result of the interested party plugging the Well, the Act
requires that the interested party repairs the damage or
disturbance, or compensate the surface owners for the
damage or disturbance.
Copies of the Special Notice of Plugging of an
Abandoned Oil or Gas Well by an Interested Party on
Form WW-4C, the permit approval from the West
Virginia Department of Environmental Protection, and
the plugging permit application, may be obtained upon
request.
