NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Deed of Trust dated January 29, 2016, executed by Roy J. Huff, Jr. and Tonya A. Huff to Kenneth Price, Trustee, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4151, at Page 129. Bailey & Slotnick, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 9, 2020, of record in the Clerk’s Office in Book 4474, at Page 240. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on: THURSDAY, JANUARY 28, 2021, AT 10:00 A.M. All that certain piece or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Laurel Fork of Blue Creek, in Elk District, Kanawha County, West Virginia, more particularly described as follows: Beginning at a No. 5 rebar with cap found on the northerly line of Kanawha County Route 65 or Trading Post Road, also a common corner between property owned by Tonya A. Harsh, et al, in Deed Book 2416, Page 23, and the property herein conveyed; thence N. 26 14′ E. 363.54 feet, leaving the said road and running with the said Harsh, et all and crossing a drain to a No. 5 rebar with cap found; thence S. 64 44′ 30″ E. 49.92 feet, continuing with the said Harsh, et al, across the said drain to a No. 5 rebar with cap found at a common corner between the said Harsh, et al, the property of Gary and Linda Robertson in Deed Book 1767, Page 32, and the property herein conveyed; thence S. 73 10′ E. 132.00 feet, leaving the said Harsh, et al, and running up the hill with the said Robertson to a No. 5 rebar with cap set, from which a plugged well marked “BLUE CREEK 22 047-039-4989-P” bears N. 2 22′ W. at 15.79 feet; thence S. 12 39′ 30″ E. 99.00 feet, continuing with the said Robertson to a No. 5 rebar with cap found, also a corner of the said Robertson; thence S. 39 50′ 30″ W. 315.29 feet, continuing with the said Robertson down the hill to a No. 5 rebar with cap found on the northerly line of the aforementioned Kanawha County Route 65 or Trading Post Road; thence leaving the said Robertson and following the said road the following three courses and distances: N. 61 32′ W. 88.25 feet, N. 71 22′ W. 30.33 feet and N. 65 56′ W. 49.88 feet to the point of beginning, containing in all 1.757 acres, more or less, all as shown more fully on a map or plat thereof entitled “PLAT SHOWING TWO PARCELS OF LAND ON THE WATERS OF LAUREL FORK OF BLUE CREEK ELK DISTRICT, KANAWHA COUNTY, WEST VIRGINIA SURVEYED FOR ROY HUFF & TONYA HUFF SCALE: 1″ = 60′ MARCH 31 2012”, as surveyed and mapped by William R. Gunnoe, Registered Professional Surveyor. Being the same property conveyed unto Tonya Huff and Roy Huff, by Jerry Barnett, by deed dated November 29, 2011, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2807, at page 803; and also being the same property conveyed by Tonya Huff (a/k/a Tonya A. Huff) and Roy Huff (a/Wa Roy J. Huff, Jr.), wife and husband, unto Tonya A. Huff and Roy J. Huff, Jr., wife and husband, by deed dated January 29, 2016, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 2931, at Page 490. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-2. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee by cashier’s check, cash or money order within thirty (30) days of the date of sale, with a minimum deposit of $6,000.00 payable to the Trustee by cashier’s check, cash or money order at the time and place of the sale.
