NOTICE OF SUBSTITUTE TRUSTEES’ SALE FEBRUARY 19, 2021 NOTICE IS HEREBY GIVEN that the Substitute Trustees will conduct a sale of the below-described property at the north front door of the Kanawha County Courthouse, 407 Virginia Street, Charleston, West Virginia on FRIDAY FEBRUARY 19, 2021 2:00 P.M. This sale will be made under that certain deed of trust (“the Deed of Trust”) dated April 9, 2019 between D&A Tri-State Construction LLC and Jason Powell (“the Trustee”), recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 4356 at Page 929, to secure payment of a promissory note of the same date (“the Note”) in the principal amount of One Hundred One Thousand Dollars ($101,000.00). As shown by documents of record in said Clerk’s Office, the Deed of Trust and the Note are currently held by PS Funding, Inc. (“the Beneficiary”). Being authorized and empowered to designate and appoint one or more substitute trustees in the place and stead of the Trustee, the Beneficiary designated and appointed the undersigned W. Being the same real estate conveyed to D&A Tri-State Construction LLC from The Secretary of Housing and Urban Development of Washington, D.C., by Deed dated April 5, 2019, and recorded in the Office of the Clerk of the County Commission, Kanawha County, West Virginia in Deed Book 3029, Page 870. TERMS OF SALE: 1. Cash in hand at the time and place of sale or such other terms as may be acceptable to the Substitute Trustees. At the sale, any person or entity may submit bid and, subject to the below-noted right of the Substitute Trustees to reject bids, may purchase the Property if they are the highest bidder. 2.
