ORDER OF PUBLICATION
The title of the above-styled civil action presently
pending in the Circuit Court of Wetzel County is Marion
County Coal Resources, Inc. v. Known and Unknown
Heirs of James M. Berdine et al, civil action no.
20-C-56. The object of the above-styled civil action is to
secure partition by allotment of the Coal within and
underlying a 2.0 acre tract, more or less, of real estate
located in Church Taxation District, Wetzel County,
West Virginia, and more particularly bounded and
described as follows:
Beginning at a white oak, a corner to the “Palmer” grave
year thence S. 20 W. 10 ¾ poles to a stone in the creek
and with the creek N. 82 W 11 poles thence N. 74 W
15 poles to a stone N. 19 E 13½ poles to a stone above
the country road, thence S. 71 E 25½ poles to the
place beginning, containing TWO (2) acres, more o
less, and being an undivided interest in the same tract
or parcel of coal conveyed to J.M. Berdine by Peter
Kennedy and Maria E. kennedy, his wife, by Deed dated
the July 15, 1916, of record in the Office of the County
Commission of Wetzel County, West Virginia in Deed
Book 54, at page 567 and to which deed reference is
hereby made for all pertinent purposes.
The said James M. Berdine died testate on July 10,
1941, and by the te4rms of his last will and testament
and codicil of record in the Office of the Clerk of Wetzel
County, West Virginia, in Will Book No. 9 at page 10, he
devised the subject property to eight children, Daisy Ann
Berdine, Fauchenatis Quipman Berdine, Margaret
Abigail Berdine, Maude berdine, Mary Lee Berdine,
Samuel Fred Berdine, James Wayman Berdine, and
Frank Lemley Berdine.
The Subject Coal Property is included and assessed on the 2020 Wetzel County, West Virginia Land Book for Church Taxation District, as

Based upon an affidavit presented to the Court by the
Plaintiff, it appears that therer are or may be persons or
parties, other than those persons or parties specifically
named and identified as Defendants, who are interested
in the subject matter of such civil action and whose
names and/or iddentities are unknown to the Plaintiffs,
but who the Plaintiffs were unable to locate bu exercise
of due diligence, which persons or parties are as
