IN THE CIRCUIT COURT OF KANAWHA COUNTY, WEST VIRGINIA RANDY WITHROW, TERRY KNUCKLES AND VELDON O. HIGGINBOTHAM, TRUSTEES OF RICH FORK BAPTIST CHURCH PLAINTIFFS, V. ALVARO MENDEZ, LEONARD PORTZ, BENZOL REEDY, JIMMIE CAMPBELL AND REX HAYES, TRUSTEES FOR KANAWHA TWO-MILE MISSION, DEFENDANTS. ORDER OF PUBLICATION The object of above styled civil action is for declaratory judgment to confirm that the Plaintiffs are the successors in interest of the Defendants and to quiet title in the Plaintiffs in and to the real property subject to this action, which consists of two (2) parcels of land situate on Kanawha Two-Mile Creek in Union District of Kanawha County, West Virginia, more particularly described as follows: Beginning at a stake in the edge of the state road and also at the edge of the Kanawha Two-Mile Creek; thence N 73 30′ W 549 feet to a fence post; thence N 10 15′ W 172 feet to a stake; thence S 68 30′ E 676 feet to a stake located on the east side of said road and which is between the said Creek and Road; thence S 27 13′ W 50 feet to a stake; thence crossing said road and creek in a southwesterly direction 106 feet, more or less, to the place of beginning, containing 1.7 acres and being Lot No. Five (5) as shown on a partition map of the Mary D. Jenkins Estate, which map was made by J. H. High, and dated November 1946 and the same conveyed by deed dated 12/8/1967 from Margaret Jenkins Craze and Harry V. Craze, her husband, and Thelma J. Hypes, widow, to Alvaro Mendez, Leonard Portz, Benzol Reedy, Jimmy Campbell and Rex Hayes, Trustees of The Kanawha Two-Mile Mission, a church of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1514 at page 563; and The southerly forty (40) feet of Lot 4 of said Mary D. Higgins Estate and described by courses and distances as follows: Beginning at a stake on the eastern side of the Kanawha Two-Mile Road, and which stake is located at the common eastern corner of Lots Nos. Four (4) and Five (5) of the Mary D. Jenkins Estate; thence with the common division line of said Lots Nos. Four (4) and Five (5), N 68 30′ W 676 feet to a stake in the outside boundary; thence with the rear line of Lot No. Four (4), N 10 15′ W 40 feet, more or less; thence leaving the rear line of said Lot Four (4) and running S 68 30′ E 676 feet, more or less, to a stake in the front line of said Lot Four (4); thence S 27 13′ W 40 feet, more or less, to the place of beginning, and being the southerly 40 feet of Lot Four (4) of the Mary D. Jenkins Estate; and being part of the same property conveyed to Thelma J. Hypes by Lessie Jenkins Vermillion and others by deed dated November 14, 1946 and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 769 at page 383, to which deed reference is hereby made and being the same property conveyed by deed of December 8, 1967 from Thelma J. Hypes, widow to Alvaro Mendez, Leonard Portz, Benzol Reedy, Jimmy Campbell and Rex Hayes, Trustees of The Kanawha Two-Mile Mission, a church of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1514 at page 565. And it appearing from Affidavit filed in said action that there may be interest holders in the above described property whose names and whereabouts are unknown to the Plaintiffs, it is therefore ORDERED that the above named Defendants, together with any unknown persons holding interest in the above described property serve upon John E. Dorsey, Plaintiff’s attorney, whose address is 407 Pennsylvania Avenue, Charleston, WV 25302, on or before April 7, 2021, an answer to the complaint herein filed, otherwise, judgment by default may be taken against the Defendant, and said unknown parties at any time thereafter. A copy of the Complaint in this action can be obtained from the undersigned Clerk at her office.
