ORDER OF PUBLICATION This Civil Action seeks a claim for damages arising from a motor vehicle accident occurring on August 8, 2018 involving Defendant Tamela Stephenson while working as a driver for Defendant C&H Company, d/b/a C&H Taxi. It appearing by affidavit filed in this action that Plaintiff Erin Ledsome has exercised due diligence to ascertain the residence or whereabouts of Defendant Tamela Stephenson, and that Defendant Tamela Stephenson cannot be found, it is hereby ORDERED that service by publication be permitted upon Defendant Tamela Stephenson pursuant to W. Va. R. Civ. P. 4(e)(C); and it is further ORDERED that Defendant Tamela Stephenson must appear and serve upon Plaintiff Erin Ledsome’s counsel, Lia DiTrapano Fairless of the DiTrapano Law Firm, LC, whose address is 604 Virginia Street East, Suite 307, Charleston, West Virginia 25301 and Elizabeth G. Kavitz, Kavitz Law PLLC, P.O. Box 8817, South Charleston, West Virginia 25303, an answer or other defense to the Complaint filed in this action by May 20, 2021, which is not fewer than thirty days after the date of the first publication of this notice, otherwise judgment by default will be rendered against her at any time thereafter. A copy of the Complaint can be obtained from the Circuit Clerk’s Office in the Kanawha County Judicial Annex, located at 111 Court Street, 2nd Floor, Charleston, West Virginia, 25301.
