NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and R. Douglas Calderwood, by that certain Deed of Trust made by Loyal Order of Moose, Moose Lodge Nitro No. 565, dated October 30, 2008 and recorded October 31, 2008 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3607 at page 84, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated April 20, 2021 and recorded May 17, 2021, in the aforesaid Clerk’s office in Trust Deed Book 4508, at page 643, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on June 21, 2021 at 9:00 a.m., all those certain lots, pieces or parcels of real property, together with improvements thereon, situate in Nitro, Union District, Kanawha County, West Virginia, being more particularly bounded and described as follows: Sale Parcel 1: BEGINNING at an iron pipe, the present northeasterly corner of the Nitro Moose Lodge lot and a common corner between the Nitro Moose Lodge lot and a tract owned by C. W. Dobbins; thence with the common division line between said Dobbins and the said Nitro Moose Lodge lot, S. 11 deg 28′ W. 7.75 feet to an iron pipe; thence leaving the said common division line and running through the said Nitro Moose Lodge lot, down the hill, N. 84 deg. 20′ W. 78.8 feet to a stake in another division line between said Dobbins and the Nitro Moose Lodge lot; thence running with the same, S. 89 deg. 50′ E. 79.5 feet to the beginning, and containing 307.00 square feet. Dobbins, his wife, by Deed dated the 6th day of May, 1964; said Deed being duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1408 at page 232. Sale Parcel 2: BEGINNING at a point on the south street line of 4th Street common corner to properties previously conveyed to McDowell Station by Charleston Industrial Corporation under deed of April 20, 1926, co-ordinating location North eight plus fifty and sixty-three hundredths East forty-six plus eighty-nine and thirty-nine hundredths, running thence in an easterly direction with said south 4th Street line for a distance of one hundred fourteen and forty-one hundredths feet to the westerly right of way line of the County Road; thence at an angle of one hundred six degrees thirty-five minutes to the right with said county road line in a southerly direction for a distance of one hundred thirty-five and sixty-four hundredths feet, to the intersection of the northerly street line of 3rd Street; thence at an angle of seventy-three degrees twenty-five minutes to the right in a westerly direction with said 3rd Street for a distance of seventy-five and seven tenths feet; thence ninety degrees to the right for a distance of one hundred thirty feet to the point of beginning; embracing an area of twenty-eight hundredths acres, more or less, being a part of Area “P”, situate in Nitro Independent District, Kanawha County, West Virginia. Said lots are shown and designated on a map entitled “Plats of Areas “P”, “R”, and “S” of Nitro Reservation”, recorded and filed in the Office of the Clerk of the County Court, Kanawha County, West Virginia, in Map Book No. 2, page 134, and also on a map entitled “Property Map of United States Government Explosives Plant “C”, Nitro, West Virginia,” and filed and recorded in said Clerk’s Office in Map Book 2, at page AND BEING THE SAME property conveyed unto the Loyal Order of the Moose, Nitro Lodge 565, Inc., by Paul Willard and Una Willard, his wife, by Deed dated the 30th day of June 1983; said Deed being duly of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2037 at page 289. At the time of execution of the deed of trust, the grantor represented that the address of the property was 101 First Avenue, Nitro, WV 25143. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and Moose International, Inc. shall not be responsible for the removal of any person or personal property from the Premises. The sale is subject to the redemption rights held by the United States Internal Revenue Service as set out in 26 USCA Section 7425(d)(1). Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
