Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated June 28, 2021, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1084, at page 327, will sell at public auction to the highest bidder on:
August 30, 2021, at 10:00 a.m.,
at the front door of the Marshall County Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Joyce A. Fahey f/k/a Joyce A. Wayt, to Ronal W. Rush, original Trustee, dated July 1, 2016, and recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 985, at page 515, and re-recorded in Deed of Trust Book 993, at page 232, and being described as follows:
The following described lot or parcel of real estate whose property address is 2915 Fernwood Avenue, Washington District 14, Map 9B, Parcel 0011 0000, situate in Washington District, Marshall County, West Virginia, and being more particularly bounded and described as follows, to-wit:

LOT Number Forty-eight (48) as shown on the Plat of Maxwell Acres, Block Two (2) which said plat is of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Plat Book No. 3, at page 3; to which plat reference is made for a more particular description of the property hereby conveyed.

Being the same property conveyed to Joyce A. Wayt from Thomas T. Boston and Jayme L. Boston, his wife, by Deed dated July 28, 2005, and recorded in Marshall County Deed Book 646, at page 477. Joyce A. Fahey (f/k/a Joyce A. Wayt) died on July 22, 2020, leaving the said William Fahey, Cheryl Supanik, Kevin Druschel and William Druschel, Jr., as her heirs at law.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
