Notice is hereby given that POCAHONTAS COAL COMPANY, LLC, 109 Appalachian Dr., Beckley, WV 25801 has submitted an application to the Department of Environmental Protection (DEP), 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for a significant permit revision to Article 3 permit number U015282 in order to revise the approved underground mining limits to add approximately 2,132 acres of additional mining area in the Pocahontas No. 3 seam and deleting approximately 148 acres of approved underground mining area in the Pocahontas No. 3 seam. This ad is required due to changes to the mining limits. The expansion will include mining under Raleigh County PSD water well at Coal City and wellhead protection zone. The revised permit will discharge into unnamed tributaries of Soak Creek and Laurel Branch of Soak Creek of Piney Creek of New River; unnamed tributaries of Crab Orchard Creek of Piney Creek of New River; Shockley Branch of Miller Camp Branch of Marsh Fork of Coal River of Kanawha River; Old Shop Branch of Winding Gulf of Guyandotte River and is located 0.75 miles southeast of Midway, in the Town, Slab Fork, and Trap Hill Districts of Raleigh County, Longitude 81deg. 13′ 42″ and Latitude 37deg. 42′ 36″ (Coordinates from USGS Topographic Map).
Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until September 6th, 2021, or ten (10) days from date of publication. A copy of the application will be available for review until September 6th, 2021, or ten (10) days from date of publication in the DEP Regional Office located at the address above and is available at:
