ADVERTISEMENT FOR BIDS MINGO COUNTY PUBLIC SERVICE DISTRICT NAUGATUCK, WV BEECH CREEK WATERLINE EXTENSION PROJECT Sealed Bids for the construction of: Beech Creek Waterline Extension Project Contract No. 1 – Furnishing all materials, labor, and necessary items for the construction and installation of approximately 32,060 LF of 8″ water line, 23,200 LF of 6″ water line, 7,375 LF of 4″ water line, 10,310 LF of 2″ water line one (1) booster pump station, two (2) pressure reducing valves, meters, valves, fire hydrants and all other items and appurtenances as outlined in the Plans and Specifications. Sealed Bids for the construction of Contract No. 1 will be received by J.B Heflin (Manager-Mingo County PSD) at the office of the Mingo County Public Service District; 1 Riverside Drive; Naugatuck, WV 25685, until 1:00 p.m. local time on November 16, 2021, at which time the Bids received will be publicly opened and read. A pre-bid meeting will be conducted at the Mingo County PSD office at 10:00 a.m. on October 27, 2021. Attendance at the pre-bid meeting is highly encouraged but is not mandatory. Separate Bids will be received for Contract No. 1 – General Construction; Bids shall be on a lump sum and unit price basis the contract, as indicated in the Bid Form. Bidders who return full sets of the Bidding Documents in good condition (suitable for re-use) within 30 days after receipt of Bids will receive a full refund. Checks for Bidding Documents shall be payable to “E.L. Robinson Engineering Company”. Upon request and receipt of the document deposit indicated above, the Issuing Office will transmit the Bidding Documents via delivery service. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. Bid security shall be furnished in accordance with the Instructions to Bidders. Bidders must comply with the Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code 21-5A-3, and the West Virginia Jobs Act (West Virginia Code 21-1C-1). All Bidders must hold a current WV Contractor License on the date of Bid opening. Any Contractor submitting a bid on this project hereby certifies, indicates, and acknowledges that he/she has a license and meets all the qualifications required by the statues of the State of West Virginia, and subdivision in which the work is to be performed. Note that the bid hold time is 90 days. DBE REQUIREMENTS Each bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid. The bidder agrees to make “good faith efforts” to sub-contract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract. NONDISCRIMINATION IN EMPLOYMENT “Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.” HUD REQUIREMENTS A five percent (5%) Bid Bond or certified cashier’s check must accompany all Bids. The successful Bidder will be required to furnish a satisfactory Payment Bond and Performance Bond, each for 100% of the contract amount. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12. U.S.C. 1701 u (Section 3). The purpose of Section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD-assisted projects covered by Section 3, shall, to the greatest extent feasible, be directed to low-and very low-income persons, particularly person who are the recipients of HUD assistance for housing. The parties of this contract agree to comply with HUD’s regulations in 24 CFR Part 135, which implement Section 3. Bidder’s attention is directed to the Section 3 “Clause” set forth in the contact documents. Bidders must comply the Drug-Free Workplace Provisions pursuant to West Virginia Code 21-1D-5.
