TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 17, 2011, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3785, at Page 616, Kenneth G Salyers did convey unto Richard A Pill and David D Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated April 27, 2021 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MIDFIRST BANK to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on November 9, 2021 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 12 – Chas W District, Kanawha County, West Virginia, and more particularly described as follows: PARCEL ONE That certain lot or parcel of land, together with the improvements thereon and the appurtenances thereon and the appurtenances thereunto belonging, situate on Eastover Road in the City of Charleston, Kanawha County, West Virginia, bounded and described as follows, to-wit: Lot “P” of the Resubdivision of Lots Nos. 118, 119, 120, 121 and 122 of the Parsons and Poling Addition to said City of Charleston, as shown upon a map thereof filed in the office of the Clerk of the County Court of said Kanawha County in Deed Book 585, at page 394. Said lot fronts 103 feet on Myers Avenue and 40 feet on Eastover Road, Being the same property conveyed unto Joe Batman and Inez B. Batman, is wife from Geneva Jones and Clarence Jones, her husband, by deed dated June 3, 1946 and recorded on June 4, 1969 in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 745, at page 489. The said Joe Boyd Batman died testate vesting property in Inez B. Batman, by virtue of joints rights of survivorship. The said Inez B. Batman died testate on November 15, 2008 devising said property unto her four children Boyd O. Batman, Joe T. Batman, Sandra L. Svec, and Randall K. Batman by virtue of her Last Will and Testament recorded in the aforesaid Clerk’s office in Will Book 794, at page 256. Also being the same property conveyed unto Kenneth G. Salyers from Boyd O. Batman, Joe T. Batman, Sandra L. Svec, and Randall K. Batman, by deed dated to be determined and intended to be recorded simultaneously herewith. References to said map, deeds and will are made for a more particular description of the property conveyed herein. PARCEL TWO All those certain lots, tracts, or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at an old fence post set in concrete in the North right of way line of Amity Drive (formerly Delmar Street, a continuation of Eastover Road) as shown on a map entitled “Survey for J. T. Boggess Lots 123, 124 & 125 Parsons-Poling Addn”, dated May 31, 1969 as prepared by W. D. Mason, Engineer, and of record in the office of the Clerk of the County Clerk office of Kanawha County, West Virginia; thence, with an old fence line, N. 22 57′ E. 218.1 feet to a one-inch iron pipe as shown on said map; thence, with the rear lot lines of part of Lot No. 123, and Lots Nos. 124 and 125, 115 feet to an old iron pipe One (1) Foot above the center of a 14-inch persimmon in the West line of a Ten (10) Foot alley and Valley View Addition; thence, with the line of Valley View Addition, S. 23 15′ W. 219.6 feet to an iron pin in the West line of Lot No. 92 of Valley View Addition owned by G. W. Flesher; thence with the line of Flesher, S. 33 20′ E 30.5 feet to an iron pin in the line of Amity Drive; thence with the line of Amity Drive, N. 57 41′ W. 78.5 feet to an iron pin; thence continuing with the line of Amity Drive, S; 79 33′ W. 35 feet to the place of beginning, being part of Lot No. 123, and all of Lots Nos. 124 and 125 of the Parsons-Poling Addition to the City of Charleston, as shown upon a map thereof prepared by Joseph Webb, dated August 1923, and of record in the aforesaid Clerk’s office in Map Book 4, at page 134; Being the same property conveyed unto Joe Batman and Inez B. Batman, is wife from Thurman Boggess, also known as James Thurman Boggess, single, by deed dated August 6, 1969 and recorded on August 20, 1969 in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1564, at page 133. The said Joe Boyd Batman died testate vesting property in Inez B. Batman, by virtue of joints rights of survivorship. The said Inez B. Batman died testate on November 15, 2008 devising said property unto her four children Boyd O. Batman, Joe T. Batman, Sandra L. Svec, and Randall K. Batman by virtue of her Last Will and Testament recorded in the aforesaid Clerk’s office in Will Book 794, at page 256. Also being the same property conveyed unto Kenneth G. Salyers from Boyd O. Batman, Joe T. Batman, Sandra L. Svec and Randall K. Batman, by deed dated to be determined and intended to be recorded simultaneously herewith. References to said map, deeds and will are made for a more particular description of the property conveyed herein. Subject to any restrictive covenants and easements of record in said Clerk’s office relative to the property herein conveyed. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 788 Amity Dr, Charleston, WV 25302. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
