And being part of the property conveyed unto James W. Paxton, Sharon L. Paxton, Connie Ann Hays, Charles D. Paxton, and Joyce L. Burdette by James I. Paxton by transfer o death deed dated April 25, 2017, of record in the aforesaid Clerk’s Office in Deed Book 2970, at page 677. The said James I. Paxton died a resident of Kanawha County, West Virginia, on August 10, 2018, and upon his death, in accordance with the provisions of the Uniform Real Property Transfer on Death Act, West Virginia Code 36-12-1 et seq., the property was transferred to the Grantors; and also being the same property conveyed unto Alexx Dennis by James W. Paxto, Sharon L. Paxton, Connie Ann Hays, Charles D. Paxton and Joyce L. Burdette by deed dated November 30, 2018, go be recorded simultaneously herewith in the aforesaid Clerk’s Office. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s Office. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1 Tall Oak Dr, Charleston, WV 25302-4800. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition.
