Notice is hereby given that RESILIENT MINING LLC, 799 HIGHWAY 3459, , HARLAN, KY 40831 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 352.6 acres and has submitted an application to the WV DEP, 1159 Nick Rahall Greenway, Fayetteville, WV, 25840, for renewal of Article 3 Permit Number S303807 to Operate a Surface Mine using Auger and/or Highwall Miner Operations in the No. 2 Gas, Powellton, Eagle A, Big Eagle, Little Eagle, Peerless and all associated splits of the Peerless seam of coal.
The operation is discharging into unnamed tributaries of/and Taylor Branch; unnamed tributaries of/and Carter Branch of Loop Creek and unnamed tributaries of/and Wingrove Branch and unnamed tributaries of/and Tincher Hollow and unnamed tributaries of/and Dempsey Branch of Laurel Creek of the Lower New River; all of the Kanawha River and is located 3.2 miles, East of Kincaid in New Haven District of Fayette County, Longitude 81deg.11’50” and Latitude 38deg.02’02” (Coordinates from USGS Topographic Map).
