NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: November 20, 2021 West Virginia Department of Economic Development (WVDED) 1900 Kanawha Blvd., East Building 3, Suite 700 Charleston, WV 25305 304-558-2234 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the WVDED. REQUEST FOR RELEASE OF FUNDS On or after December 6, 2021 the WVDED will submit a request to HUD for the release of Community Development Block Grant-Disaster Recovery funds (CDBG-DR) under Public Laws 114-223, 114-254, and 115-31 of the Continuing Appropriations Act of 2017 (HUD/State Identification Number B-16-DL-54-0001), authorized by the Title 1 of the Housing and Community Development Act of 1974, as amended, (42 USC 5301 et. seq), to undertake the following project: Project Title: Monarch Village Purpose: Monarch Village (Project) will involve the acquisition of contiguous parcels, demolition of existing structures, and new construction of a multifamily residential rental development consisting of a two-story building with 12 units serving seniors who earn at or below 80% AMI. Location: 3, 5, 7, and 9 Kanawha Avenue, Clendenin, Kanawha County, WV 25045 Estimated Cost: Estimated total Project cost is $2,795,000 and estimated CDBG-DR funding $2,595,000. FINDING OF NO SIGNIFICANT IMPACT The WVDED has determined that the Project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the WVDED. All comments received by December 5, 2021 will be considered by the WVDED prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The WVDED certifies to HUD that Jennifer L. Ferrell in her capacity as Director, Community Advancement and Development, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Monarch Village LLC to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the WVDED’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the WVDED; (b) the WVDED has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the Project is unsatisfactory from the standpoint of environmental quality.
