NOTICE OF PUBLIC COMMENT PERIOD AND PUBLIC HEARING REGARDING THE PROPOSED PROMULGATION OF THE FAYETTE COUNTY SOLID WASTE AUTHORITY CODE OF RULES
Pursuant to the express rulemaking authority conveyed to it by W. Va. Code Sections 22C-4-23(3), (5) and (17), the Fayette County Solid Waste Authority, an Instrumentality of the State of West Virginia created by W. Va. Code Section 23C-4-3(a), proposes to promulgate a Code of Rules to establish definitions and procedures to enable the Fayette County Solid Waste Authority properly to discharge its statutory responsibilities imposed by W. Va. Code Sections 22C-4-8 and 23 regarding appropriate Solid Waste management, planning and remediation within Fayette County.
On November 16, 2021, the Fayette County, West Virginia Solid Waste Authority gave notice to the public on the Fayette County Solid Waste Authority’s regularly maintained and published webpage, https://fayettecounty.wv.gov/departments/Pages/solid-waste-authority.aspx, and by posting at the Fayette County Courthouse that the Fayette County Solid Waste Authority is opening a Public Comment Period for receipt of written comments on the Authority’s PROPOSED ADOPTION OF THE CODE OF RULES FOR THE FAYETTE COUNTY SOLID WASTE AUTHORITY. Anyone wishing to submit written comments regarding any of the proposed Rules for consideration by the Authority must submit those written comments to the office of the Fayette County Solid Waste Authority, P.O. Box 307, Fayetteville, WV, 25840, before 12:00 noon on December 16, 2021.The proposed Rules may be viewed at: https://fayettecounty.wv.gov/departments/Pages/solid-waste-authority.aspx.
Copies of the proposed Rules may be obtained from the office of the Fayette County Solid Waste Authority, Fayette County Courthouse, Fayetteville, WV.
ALSO, PLEASE TAKE FURTHER NOTICE that the Fayette County Solid Waste Authority has scheduled a Public Hearing before the Fayette County Solid Waste Authority to receive public comment on the proposed Rules. This Public Hearing to receive public comment on the proposed Rules will commence on December 16, 2021 at 5:00pm. The Public Hearing will take place at the County Commission Chambers, Fayette County Courthouse, Fayetteville, WV.
