Notice is hereby given that ELK RUN COAL COMPANY, LLC, PO BOX 457, , WHITESVILLE, WV 25209 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 47.21 acres and has submitted an application to the DEP, 1101 George Kostas Drive, Logan, WV, 25601 , for renewal of Article 3 Permit Number U502400 to Coal Underground in the Lower Cedar Grove seam of coal. The operation is discharging into Browns Branch, Left Fork of James Creek and Jarrells Branch of West Fork of Pond Fork of Little Coal River; Unnamed Tributaries of Elk Run and Elk Run and Logan Fork of Hopkins Fork of Laurel Creek of Big Coal River of Coal River of Kanawha River and is located 2.3 miles, southwest of WHITESVILLE in SHERMAN/CROOK District of Boone and Raleigh Counties, Longitude 81 o 34 ‘ 16 ” and Latitude 37 o 57 ‘ 31 ” (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until March 24th, 2022, or thirty (30) days from the date of final publication. A copy of the application will be available for review until March 24th, 2022, or thirty (30) days from the date of final publication in the DEP Regional Office located at the address above and is available at:
