NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 29, 2007, executed by Borrower(s), Mark D. Shrader, to Harold Brewster, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1111, at Page 529. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2145 Harman School Road, Princeton, WV 24740. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 20, 2022, of record in the Clerk’s Office in Book 1432, Page 725. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

18th day of March, 2022
at 11:30 a.m.

That certain tract or parcel of land, together with the improvements thereon and appurtenances thereunto belonging, described as the eastern portion of Parcel J-2 of the Bishop Subdivision as shown on a Plat prepared by Dana Pettrey, recorded in the office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 8572, which property is more fully bounded and described as follows: BEGINNING at the northwest corner of Parcel D, which lies on the east side of the Harmon School Road; thence N. 15 degrees 34` 07″ W. 118.17 feet along the east side of the Harmon School Road to a point; thence N. 10 degrees 17` 49″ W. 85.64 feet continuing the east side of the Harmon School Road to a point; thence N. 4 degrees 46` W. 197.95 feet to the center of a 40 foot wide right-of-way; thence running with the center of said 40 foot wide right of way the following calls: S. 89 degrees 49` 28″ E. 35.41 feet; thence S. 46 degrees 04` 19″ E. 28.78 feet; thence S. 28 degrees 41` E. 61.59 feet; thence S. 28 degrees 48` 07″ E. 86.96 feet; thence S. 37 degrees 13` E. 94.26 feet; thence S. 62 degrees 50` 43″ E. 64.75 feet; thence leaving said roadway S. 16 degrees 11` 18″ E. 95.00 feet, more or less, to a point on the Northern line of Parcel D; thence with same, S. 77 degrees 56` 51″ W. 178.72 feet to the place of the BEGINNING; There is expressly excepted and reserved from the above property a 40 foot roadway as it is shown upon the aforesaid map, said roadway lying 20 feet on each side of the common line between Parcel J-1 and Parcel J-2. Being the same property conveyed by Orville Lee Shew, Jr. and Pamela Jane Shew, his wife, to Mark D. Shrader, by Deed dated May 29, 2007, and recorded in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book No. 911, at page 451.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
