NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 22, 2002, executed by Borrower(s), David K Gray and Emma Lou Gray, to CTC Real Estate Services, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 945, at Page 277. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3184 Hinton Rd, Athens, WV 24712. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 2, 2019, of record in the Clerk’s Office in Book 1371, Page 148. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

18th day of March, 2022
at 12:00 p.m.

All that certain parcel of land situate in the County of Mercer and State of West Virginia being known and designated as follows:
All of that certain tract or parcel of real estate designated as Tract “B” on “Map Showing Division of Parcel 91, Tax Map 12, State Route 20 – Speedway, Plymouth District, Mercer County, West Virginia, Appalachian Engineering and Surveying, Job No. 97207, Date: 07/07/1997, Scale 1″ = 40′,” which said Map is attached hereto and intended to be recorded herewith and which said tract is more particularly bounded and described as follows:

Beginning at an iron bar in a fence line, said bar located North 77 degrees 36′ East 134.36 feet from an iron pipe at the southwest corner of Parcel 91, said bar being in the northern line of parcel 88.5 and the southeast corner of Tract “A”, said bar also being the southwest corner of the herein described tract; thence through Parcel 91, North 25 degrees 48′ 23″ West 244.89 feet to an iron bar; thence along the southern line of Parcel 92.3, North 62 degrees 22′ East 117.13 feet to an iron bar; thence through Parcel 91, South 25 degrees 48′ 23″ East passing an iron bar on line at 176.74 feet and another iron bar at 270.19 feet and continuing for a total distance of 276.53 feet to a point; thence along the northern line of Parcels 89 and 88.5 South 77 degrees 36′ West 120.35 feet to the point of beginning and containing 0.7 acres, more or less.
Also included is a non-exclusive easement twelve (12) feet in width, the centerline of which is shown on said plat leading from and through the property conveyed herein to West Virginia State Route 20.

Being the same property conveyed to David K Gray and Emma Lou Gray by the Deed dated July 24, 1997 and recorded in Deed Book 785 at Page 401 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
