Williams, who was born on June 20, 2019. A petition has been filed in the Circuit Court of Kanawha County, West Virginia to permit the adoption of this child. A hearing has been set for Monday, April 4, 2022 at 9:00 A.M. before the Honorable Kenneth Ballard, Circuit Court Judge, Kanawha County Courthouse, 111 Court Street, Charleston, WV 25301 in which you currently may appear and defend any such parental rights you may possess. It appearing from an Affidavit filed in this civil action that Petitioners have been unable to effect service of process against the paternal grandparents, as described in Rule 4 of the West Virginia Rules of Civil Procedure and Section 48-22-602(c) of the West Virginia Code and have exercised due diligence but have been unable to ascertain the paternal grandparents’ current residence or whereabouts. Thus, an order of publication may be entered against the Respondent pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure and Section 48-22-602(c) of the West Virginia Code. It is therefore ORDERED that the above-named paternal grandparents may appear within thirty (30) days after the date of the first publication hereof, serve an answer to Petitioners’ Petition for Adoption upon Petitioners’ counsel, David S. Hughart, Esq., Ray, Winton & Kelley, PLLC, 109 Capitol Street, Suite 700, Charleston, West Virginia 25301. Otherwise, the paternal grandparents may not appear in or receive further notice of the adoption proceedings and your parental rights, if any, may be terminated in the proceeding. This Order of Publication shall be published once a week for two successive weeks in a newspaper of general circulation in Logan County, West Virginia and Kanawha County, West Virginia.
