Notice is hereby given that the undersigned Trustee, will sell at public auction to the highest bidder on:
Wednesday, March 9, 2022, at 10:00 a.m.,
at 392 Rose Street, Follansbee, Brooke County, West Virginia, that certain property conveyed by Patricia L. Roscoe, Unmarried and Rose Ferguson, Unmarried to James C. Gardill, Trustee, by Deed of Trust dated September 1, 2015, and recorded in the office of the said Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 544, at page 666, and being described as follows:
All that certain lot or parcel of land situate in Follansbee District, Brooke County, West Virginia, being more particularly bounded and described as follows, to-wit:
Beginning at the northwest corner of lot No. 3 of W.D. Davidson’s First Addition Plan of Follansbee; thence S. 27* 38′ W. 35 feet to a stake in the line of Rose Alley; thence S. 73* 11′ E. 112.9 feet to a stake; thence N. 25* 04′ E. 34.738 feet to a stake; thence S. 73* 11′ E. 111.27 feet to the place of beginning, and subject to all restrictions and reservations contained in the Deed of William Hecker, et. ux. to Ethel M. Fletcher, which Deed bears date the 26th day of May, 1923, and is of record in the Office of the Clerk of the County Court of Brooke County, West Virginia in Deed Book No. 53, at Page No. 107; Said parcel is located in W.D. Davidson’s First Addition Plan of Follansbee, West Virginia, a plat of which is of record in the aforesaid Clerk’s Office in Deed Book No. 38, at Page No. 365.
Being the same property conveyed to Rose Ferguson and Patricia L. Roscoe, as Joint Tenants with the Right of Survivorship, by deed of Rose Ferguson, widow, dated August 12, 2015, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed Book No. 363, at Page No. 10. Being further the same property which was conveyed to Rose Ferguson by deed of Patricia L. Roscoe and Bruce Roscoe, wife and husband, Cynthia Blackburn and Eugene Blackburn, wife and husband, and Cheryl Andress and Robert J. Andress, wife and husband dated August 5, 1992, and recorded in the Brooke County Clerk’s Office in Deed Book No. 260, at Page No. 291.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of ways easements, conditions, covenants, restrictions, leases and other servitude’s of record if any pertaining to said real estate: (2) any and all unpaid taxes assessed against said property: (3) The subject property will be sold in “as is” condition: (4) The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property: (5) The Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120 day redemption period pursuant to 26 U.S.C.A. Section 7424(d).
