Notice is hereby given that Kirby Land Company, Inc., PO Box 2178, Beaver, WV 25813 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 570.89 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number S301613 to operate and maintain a surface mine and haul road in the all splits of/and the Beckley seam of coal.
The operation is discharging into unnamed tributaries of/and Bowyer Creek, Take-In Creek and Beaver Cree; all of Piney Creek of the New River and is located 2.2 miles northwest of Ghent in Shady Spring District of Raleigh County, Longitude 81deg. 8′ 12″ and Latitude 37deg. 38′ 38″ (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until March 11, 2020, or thirty (30) days from the date of final publication.
