WATERLINE EXTENSION, REPLACEMENT & UPGRADE PROJECT
ADVERTISEMENT FOR BIDS
Sealed Bids for the construction of:
Exchange Road Phase III Waterline Extension, Replacement & Upgrade Project
Contract No. 1 – Furnishing all materials, labor, and necessary items for the construction and
installation of approximately 610 LF of 10” waterline, 9,520 LF of 8-inch waterline, 9,600 LF of 6-inch
waterline, 460 LF of 1-inch service line, 640 LF of ¾-inch service line, fire hydrants, valves, meters,
water main reconnections, service line reconnections and other related appurtenances as outlined
in the Plans and Specifications.
Sealed Bids for the construction of Contract No. 1 will be received by Rodney Pritt (PSD General
Manager) at the office of the Flatwoods-Canoe Run Public Service District until 1:00 p.m. local time on
December 4, 2025, at which time the Bids received will be publicly opened and read. A non-mandatory
pre-bid conference will be conducted at the Flatwoods-Canoe Run PSD Office, 406 Main St., Sutton,
WV 26601 at 10:00 am on November 13, 2025.
Contract Times: 210 calendar days to substantial completion and 240 calendar days to complete work
ready for final payment.
Bidders on this work will be required to comply with the President’s Executive Order 11246, HUD
Section 109, which prohibits discrimination in employment regarding race, creed, color, sex or national
origin, and have non-segregated facilities.
This CDBG-Small Cities Block Grant project is to be financed in part by a grant from the United States
Department of Housing and Urban Development (HUD) and the West Virginia Development Office and
will be referred to as Flatwoods-Canoe Run PSD – Exchange Road Phase III Waterline Extension,
Replacement & Upgrade Project.
The work to be performed under this contract is subject to the requirements of Section 3 of the Housing
and Urban Development Act of 1968, as amended, 12 U.S.C. 170l u (Section 3). The purpose of Section 3
is to ensure that employment and other economic opportunities generated by HUD assistance or HUD
assisted project covered by Section 3, shall, to the greatest extent feasible, be directed to low- and very
low-income persons, particularly persons who are recipients of HUD assistance for housing.
The parties of the contract agree to comply with HUD’s regulations in 24 CFR Part 135, which implement
Section 3. Bidder’s attention is directed to the Section 3 “Clause” set forth in the contract documents.
Bidders must comply with the requirements for Affirmative Action and Minority Business Enterprises
participation as described in the Federal Specifications insert to the Contract Documents. Bidders must
comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, and the West Virginia Division of
Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21-5A-3.
Bids shall be submitted on the furnished Bid forms. Bids shall be on a unit price basis as indicated on the
Bid Form. The bids shall be submitted using the two (2) envelope system. Envelope #1 will contain the
required bid documents. Envelope #2 will contain only the bid form and bid schedule.

A five percent (5%) Bid Bond or certified cashier’s check must accompany all Bids. The successful Bidder
will be required to furnish a satisfactory Payment Bond and Performance Bond, each for 100% of the
contract amount.
No Bidder may withdraw their bid for a period of ninety (90) days after the time of the opening of the
Bids.
All bidders are required to have a West Virginia contractor’s license per Section 21-11-11 of the West
Virginia Code. A Contractor’s License Number is to be included on the bid submission.
Any Contractor submitting a Bid on this project hereby certifies, indicates and acknowledges that he/she
has a license and meets all the qualifications required by the statutes of the State and Subdivision in
which the work is to be performed.
DBE Requirements
Each Bidder must fully Comply with the Disadvantaged Business Enterprises, and Affirmative Action
Requirements, as identified in the contract documents. The Bidder agrees to make “positive efforts” to
subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall
be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to
demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term
“subcontract” includes all construction, modification, and service work contracted for by the bidder in
the execution of the work under this contract.
American Iron and Steel Requirement
P.L. 113-76, Consolidated Appropriations Act, 201 (Act), includes an “American Iron and Steel (AIS)”
requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking
Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are
produced in the United States for projects for the construction, alteration, maintenance, or repair of a
public wastewater and water system or treatment works.
Pursuant to West Virginia Code § 5-22-2, requirements stated in the advertisement for bids and the bid
form may not be waived by any public entity.
All bidders are required to have a WV contractor’s license in accordance with Section 21-11-11 of the
WV State Code.
The Owner reserves the right to reject any or all bids.
Each Bidder must submit with his bid, security in the amount, form, and subject to the conditions
provided for in the Information for Bidders.
No Bidder may withdraw his bid within 90 days after the actual date of the opening thereof.
All fees associated with the purchase of Project Specifications, Contract Documents, Plans, and Shipping
are non – refundable.
