ADVERTISEMENT FOR BIDS KANAWHA COUNTY REGIONAL DEVELOPMENT AUTHORITY UPPER RAMBLING HILLS ROAD WATER LINE EXTENSION KANAWHA COUNTY, WEST VIRGINIA Sealed Bids for the construction of the Upper Rambling Hills Road Water Line Extension will be received by the Kanawha County Regional Development Authority located at 407 Virginia Street East, Charleston, West Virginia 25301 until April 29, 2026, at 2:00 PM local time at which time all proposals which have been submitted in accordance with the conditions of this project will be publicly opened and read aloud. The Project consists of furnishing labor and materials and performing all work set forth in the Advertisement for Bids, Information for Bidders, Bid and Bid Schedule (Bid Form including Unit Price Basis of Bid), General Conditions, Supplementary Conditions, Specifications Special Conditions, Technical Specifications and Plans (Drawings) prepared by Potesta & Associates, Inc., and all addenda issued prior to receipt of Bids. The Work to be bid upon is generally described as follows: Approximately 2,600 linear feet of 4-inch, 2,600 linear feet of 2-inch water line and associated appurtenances. Approximately 12 service connections and associated appurtenances. One booster station and associated appurtenances. One portable generator and associated appurtenances. Extension of electrical services to proposed booster station. Other water line components work for a complete installation. Construction time limit for the contract is 270 consecutive calendar days to substantial completion for Base Bid work and 300 consecutive calendar days to final completion. The work will be substantially completed and ready for final payment after the date when the Contract Times commence to run as listed above. The liquidated damages shall be $750.00 per day. Bidder information: Submitted by: (insert name and address of bidder)" Bids will be opened and read aloud at the Kanawha Regional Development Authority's Office, Kanawha County Commission Courtroom, 407 Virginia Street East, Charleston, West Virginia 25301 beginning at 2:00 P.M. on April 29, 2026. Envelope No. 1 will be opened first, and the Bid Opening Requirement items checked for compliance as outlined in the Bid Opening Requirement Checklist in the Instructions for Bidders of these contract documents. If such documents are found to be in order, Envelope No. 2 "Contractor's Bid Form," will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. 1 are not in order, Envelope No. 2 "Contractor's Bid Form" will not be opened, and the Bid will be considered non-responsive and will be returned to the Bidder. The successful low bidder will be provided four (4) complete set of plans and specifications at no additional cost after the contract has been signed. Any additional plans or specifications that are requested will be provided at a cost of seventy-five dollars ($75.00) for each set of plans and seventy-five dollars ($75.00) for each set of specifications. Payment by either cash or check must be made upon delivery. A bidder may not withdraw his bid for a period of ninety (90) days after the date set for the opening of bids. Bids shall be accompanied by a certified check or bid bond payable to the Kanawha Regional Development Authority in an amount not less than five percent (5%) of the base bid. A mandatory pre-bid conference will be held at 10:00 AM local time on April 9, 2026 at the Kanawha Regional Development Authority's Office, Kanawha County Commission Courtroom, 407 Virginia East, Charleston, West Virginia 25301. Attendance at the pre-bid conference is mandatory. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the Bidders. Kanawha Regional Development Authority reserves the right to reject any and/or all bids. Bidders must comply with the President's Executive Order Nos. 11246 and 11375, which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must comply with Title VI of the Civil Rights Act of 1964, the Anti-Kickback Act, Section 3 Segregated Facilities, Section 109 and the Contract Work Hours Standard Act. Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed or national origin. Federal Law prohibits discrimination on the grounds of race, color, national origin, religion, age, handicap, and sex in this project. Minority firms are particularly encouraged to participate. Bidders must comply with Disadvantaged Business Enterprise utilization or EPA Federal Regulation 40 CFR Part 33- Procurement Under Assistance Agreements stated that loan recipients and Contractors must comply with six affirmative-steps as outlined on 33.240 and any other requirements of the state. The Contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The Contractor shall carry out applicable requirements of 40 CFR Part 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies. DBE REQUIREMENTS Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business enterprise (DBE) participation during the performance of this contract. The Bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid. The Bidder agrees to make "good faith efforts" to subcontract a portion of the total value of the contract to Disadvantaged Businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term "subcontractor" includes all construction, modification, and service work contracted for by the Bidder in the execution of the work under this contract. NONDISCRIMINATION IN EMPLOYMENT "Bidders on this work will be required to comply with the President's Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications." Bidders are required to have West Virginia Contractor's license per section 30-42-12 of the West Virginia Code. WV JOBS ACT REQUIREMENTS Bidders are required to comply with the WV Jobs Act (SB103) WV Code 21-1C-1 CONTRACTOR'S SALES TAX EXEMPTION "The (Owner) is exempt from West Virginia Sales Taxes and, by West Virginia Code 11-15-8d, can now extend this tax exemption to Contractors supplying goods on their behalf. The Contractor shall coordinate with the (Owner) the filing of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid." WV ALCHOL AND DRUG FREE WORKPLACE ACT West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed Drug-Free workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor's compliance with the provision of article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug-Free workplace affidavit in the first envelope shall result in disqualification of such bid.
