ADVERTISEMENT FOR BIDS TOWN OF MASON MASON COUNTY, WEST VIRGINIA WATER SYSTEM IMPROVEMENTS CLIFTON AREA EXTENSION General Notice The Town of Mason (Owner) is requesting Bids for the construction of the following Project: Water System Improvements Clifton Area Extension Bids for the construction of the Project will be received at the Town Hall in the Town of Mason, 656 2nd Street, Mason, WV 25260, June 23, 2026, at 1:00 pm, local prevailing time. At that time, the Bids received will be publicly opened and read. The Project includes the following Work: Clifton Area Extension The project would include the replacement of approximately 13,400 linear feet of water line, and radio-read water meters. Any contract or contracts awarded under this advertisement for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund. Neither the United States, the State of West Virginia nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract. No bid may be withdrawn for a period of ninety (90) days after the time of the opening of bids. Obtaining the Bidding Documents The Bidding Documents may be examined at the following locations: Ghosh Engineers, Inc. 1 Dunbar Plaza, Suite 200 Dunbar, WV 25064 Town of Mason 656 2nd Street Mason, WV 25260 Contractor's Association of WV 2114 Kanawha Blvd., E Charleston, WV 25311 Prospective Bidders may obtain the Bidding Documents at the Issuing Office (the office of Ghosh Engineers, Inc.) on Monday through Friday between the hours of 8:00 am to 4:00 pm. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office. All Bidders must be a registered holder of Bidding Documents with the Issuing Office. Printed copies of the Bidding Documents may be obtained from the Issuing Office by paying a NON-REFUNDABLE payment of $175.00 for this Project. The shipping cost for each request will be an additional $25.00. Pre-bid Conference A MANDATORY pre-bid conference for the Project will be held on June 11, 2026, at 3:00 pm (local prevailing time) at the Town Hall in the Town of Mason, 656 2nd Street, Mason, WV 25260. Bids will not be accepted from Bidders that do not attend the mandatory pre-bid conference. Bid Security A certified check made out to the Owner, or a Bid Bond executed by the Bidder and Bidder's surety company approved by the Owner, in the amount equal to five percent (5%) of the bid, shall be submitted with each bid. No bid shall be waived or returned because the bidder failed to or cannot comply with any requirements as set forth in the Plans, Specifications, or any applicable statues of the United States, the State of West Virginia, and/or local ordinance. Bidding Method The Bid package must be submitted in two (2) envelopes. The envelopes must contain the following: Envelope No. 1 a. Bid Bond b. Certification of Non-Segregated Facilities c. EEO Certification d. Certification of Receipt of Addenda to Plans and Specifications e. West Virginia Contractor's License Number f. Drug-Free Workplace Affidavit g. Build America, Buy America Certification h. Disadvantaged Business Enterprise Certification Envelope No. 2 i. Bid Form Contractor's License All bidders are required to have a West Virginia Contractor's License per Section 30-42-12 of the West Virginia Code. West Virginia Alcohol and Drug Free Workplace Act West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires that each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed Drug Free Workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor's compliance with the provisions of Article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug Free Workplace affidavit in the first envelope shall result in disqualification of such bid. Notice of Federal Wage Rates Contractors are required to comply with all federal wage rates issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification. Nondiscrimination In Employment Bidders on this work will be required to comply with the President's Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications. Suspension And Debarment Recipient shall not entertain the use of businesses that are listed on the 'System for Award Management (SAM)' at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180. DBE Requirements Each bidder must fully comply with the Disadvantaged Business Enterprises, and Affirmative Action requirements, as identified in the contract documents. The Bidder agrees to make "good faith efforts" to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term "subcontract" includes all construction, service, and modification work contracted for by the bidder in the execution of the work under this contract. Contractor's Sales Tax Exemption The Town of Mason is exempt from West Virginia Sales Taxes and, by West Virginia Code 11-15-8d, can now extend this tax exemption to Contractors supplying goods on their behalf. The Contractor shall coordinate with the (Town/PSD) the filing of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid. Build America, Buy America Requirement P.L. 117-58, Infrastructure Investment and Jobs (IIJA) Act, 2021 (Act), includes a "Build America, Buy America (BABA)" requirement in Sections 70911 through 70917 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron, steel, manufactured products, and construction materials that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works. Time of Completion The Time of Substantial Completion for this Contract shall be 180 consecutive calendar days beginning with the Award of Contract and written Notice to Proceed. Final Completion shall be 210 consecutive calendar days as described above. Liquidated damages for this project shall be assessed at $500.00 per day. Instructions to Bidders.
