TRUSTEE’S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by April Nicole Barnett to James D. Watkins, Jr., Trustee(s) dated June 26, 2012, and recorded in the office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1032, at page 355, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated October 27, 2014, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on

January 23, 2015

at 11:33 a.m.,

at the front door of the courthouse of Marion County, West Virginia, the real estate conveyed by said deed of trust and situate in Lincoln District, Marion County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 541 Pike Street, Monongah, West Virginia and being more particularly bounded and described therein as follows:

The following described parcels of real estate situate near the Town of Monongah, Lincoln District, Marion County, West Virginia:

FIRST PARCEL: Lot No. 14 of the Martha Addition, beginning at a point at the intersection of two 15 feet wide alley rights of way, thence running with the southeastern line of one of said alleys, N. 27˚ 40’ 16” E. 30.10 feet to an iron pin and cap set in the northwestern corner of Lot No. 13, of said addition; thence running with the southwestern line of Lot No. 13 S. 67° 08’ 00” E. 103.79 feet to an iron pin and cap set in the northerly right of way of Pike Street; thence with the northern right of way line of Pike Street, S. 18˚ 12’ 35” W. 40.00 feet to an iron pin and cap set at the intersection of the northern line of Pike Street and the eastern line of a 15 foot wide alley; thence with line of said alley, N. 61˚ 59’ 00” W. 110 feet to the place of beginning, containing 0.085 acre, more or less.

SECOND PARCEL: Beginning at a mag nail set in a pipe in the northern line of Pike Street and the southeastern corner of the Bragg tract; thence with the eastern line of said tract, N. 49˚ 45’ 00” E. 91.00 feet to an iron pin and cap set, being the southwestern corner of the Evans tract (Tax Map No. 34, Parcel 28); thence running with two lines of Evans , N. 27˚ 01’ 00” E. 40.00 feet to an iron pin and cap set; thence N. 30˚ 32’ 15” E. 42.02 feet to an iron pin and cap set in the western line of a 15 foot wide alley; thence with said alley, S. 61˚ 59’ 00” E. 97.50 feet to a mag  nail set at the intersection of the northern line of Pike Street and the Western line of said 15 foot wide alley; thence running with two lines of Pike Street, S. 27˚ 49’ 46” W. 50.18 feet to a tract spike set; thence S. 38˚ 57’ 13” W. 52.02 feet to the place of beginning, containing 0.204 acre, more or less.

THIRD PARCEL; PART OF LOT NUMBER THIRTEEN (13), beginning at an iron and cap set in the southeastern line of a 15 foot wide alley, common northern corner of Lots Nos. 13 and 14, then running with the line of said alley, N. 27˚ 40’ 16” E. 6.00 feet to an iron pin and cap set; thence with arbitrary line through Lot No. 13, S. 63˚ 49’ 14” E. 103.46 feet to an iron pin and cap set in the northwestern line of Pike Street and the southern common corner of Lots 13 and 14; thence running with  the eastern  line of Lot No. 14, N. 67˚ 08’ 00” W. 103.79 feet to the place of beginning, containing 310.27 square feet, more or less.

Maps or plat of said parcels are recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book No. 1016, Pages 373 and 377 and incorporated herein by reference for all pertinent purposes.

Being the same real estate that was conveyed to April Nicole Barnett by John W. Jones, III and Crystal Jones, husband and wife by deed dated June 21, 2012 and recorded in said Clerk’s Office in Deed Book No. 1116, Page 209.

This conveyance is made subject to all exceptions, reservations, easements, covenants, conditions, agreements and limitations on record affecting said real estate to extent the same are now effective.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale.  The West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE:  Cash in hand on day of sale.
