Bartlett and Sherri L. Bartlett did convey unto Susan L. Petrella and Anthony J. Julian, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont District, Marion County, West Virginia, and more particularly described as follows:
All of the following described four contiguous and adjoining lots or parcels of real estate, together with all appurtenance thereunto belonging, situate in the Sterling Heights Addition in the City of Fairmont, Fairmont District, Marion County, West Virginia, as shown on a plat of said Sterling Heights of record in the Office of the Clerk of the County Court of Marion County, West Virginia, in Deed Book No. 258, at Page 216 1/2, that is to say:
PARCEL NO 1: ALL OF LOT NO. 242 of said Addition, beginning at a point on Owen Street, now Bailey Circle, at a common corner or Lots No. 242 and 243, and running thence with said (Owen) Street, S. 87 deg. 13′ E. 55.37 feet to a point in an eight foot alley separating Lots No. 241 and No. 242, as shown on said plat, and running thence with said alley N. 5 deg. 46′ W. 120 feet to a point in Sterling Road; thence with a line in said Sterling Road, N. 87 deg. 13′ W. 19.69 feet to a point, a corner to Lots No. 243 and No. 242; and thence with the line of said Lots No. 243 and No. 242, S. 11 deg. 20′ W. 120 feet to a point on said Owen Street (Bailey Circle), the place of beginning.
PARCEL NO. 2: ALL OF LOT NO. 243 of said Addition, beginning at a stake in the southern side of Sterling Road, a corner to Lot No. 244, thence with the eastern line of said Lot No. 244, S. 28 deg. 26′ W. 120 feet to a stake in the northern side of Owen Street, now Bailey Circle; thence with the line of said (Owen) Street, S. 70 deg. 07′ E. 63.46 feet to a stake, a corner to Lot No. 242; thence with the western line of said Lot No. 242, N. 11 deg. 20′ E. 120 feet to a stake in the southern side of said Sterling Road; and thence with said southern side of said Sterling Road, N. 70 deg. 07′ W. 27.78 feet to the place of beginning.
PARCEL NO. 3: ALL OF LOT NO. 244 of said Addition, beginning at a point at the common corner of Lot No. 244 and Lot No. 245, in the northern line of Owen Street, now Bailey Circle, and running thence with the line of said (Owen) Street, S. 61 deg. 34′ E. 50 feet to Lot No. 243; thence with the common boundary between said Lot No. 243 and said Lot No. 244, N. 28 deg. 26′ E. 120 feet to the southern side of Sterling Road; thence with said Sterling Road, N. 61 deg. 34′ W. 50 feet to the common corner of said Lot No. 244 and Lot No. 245; and thence with the common boundary between said Lots No. 244 and No. 245, S. 28 deg. 26′ W. 120 feet to the place of beginning.
PARCEL NO. 4: ALL OF LOT NO. 245 of said Addition, beginning at the common corner of Lot No. 246, and said Lot No. 245, in the northern line of Owen Street, now Bailey Circle, and running thence S. 61 deg. 34′ E. 50 feet to Lot No. 244; thence with the boundary of said Lot No. 244, N. 28 deg. 26′ E. 120 feet to the southern line of Sterling Road; thence with said Sterling road, N. 61 deg. 34′ W. 50 feet to said Lot No. 246; and thence with the boundary line of said Lot No. 246, S. 28 deg. 26′ W. 120 feet to the place of beginning.
LESS: All that part of Lot Number Two Hundred Forty-five (245) which was conveyed by George Turchin and Kathy M. Turchin, husband and wife, to Jerome Andrew Turchin, by deed dated the 6th day of June, 1978, and of record the 21st day of June, 1978, in the Office of said Clerk in Deed Book No. 811, at Page 1075. More completely described as:
SECOND PARCEL: ALL THAT PART OF LOT NUMBER TWO HUNDRED FORTY-FIVE (245), of said Addition, beginning at the common corner of Lots Nos. 246 and 245, in the northern line of Owen Street, now Bailey Circle, and running thence S. 61 deg. 34′ E. 20 feet to a stake; thence with an arbitrary line thru said Lot No. 245, N. 28 deg. 26′ E. 120 feet to the southern line of Sterling Road; thence with said Sterling Road, N. 63 deg. 34′ W. 20 feet to said Lot No. 246; and thence with the boundary line of said Lot Nos. 245 and 246, S. 28 deg. 26′ W. 120 feet to the place of beginning, containing 2400 square feet, more or less, and being part of Parcel No. 4.
Such as the coal and minerals within and underlying said four lots hereinbefore described, together with the mining and removal rights and privileges hereunto belonging, as has heretofore been excepted, reserved, and conveyed away, is also hereby excepted and reserved from the operation of this conveyance.
This conveyance is made subject to only such reservations, covenants, agreements, and easement affecting said property as may be still in full force and effect.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of
142 Steriling Road,
Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to David E. Bartlett and Sherri L. Bartlett, by Deed dated January 28, 2002, from Ronald Gene Turchin and Linda L. Turchin, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 973, at Page 846.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
