ADVERTISEMENT FOR BIDS FOR CITY OF THOMAS
PROPOSED 56,000 GALLON BENBUSH WATER STORAGE TANK
TUCKER COUNTY, WEST VIRGINIA
CEC PROJECT #313-210
Sealed bids will be received by the City of Thomas for the proposed 56,000 Gallon Benbush Water Storage Tank until 2:00 P.M. on 5th, November, 2024, at 307 Spruce Street, Thomas, WV 26292 at which time bids will be publicly opened and read aloud.
All work as described below shall be substantially complete within 210 calendar days after the date when the Contract Times commence to run and completed and ready for final payment within 240 days after the date when the Contract Times commence to run. Liquidated damages shall be $1,000 per day.
The work to be bid upon is described as follows:
This project consists of the construction of a new 56,000 gallon water storage tank adjacent to the existing water storage tank, installation of new 8” ductile iron water lines and connecting to existing water lines, sanitizing the new water tank and placing it into service, abandoning and removing the existing steel water tank, installing 6’ chain link fencing, and other necessary appurtenances.

Complete sets of the Bidding Documents may be obtained from the office of Civil & Environmental Consultants, Inc. – 120 Genesis Boulevard, Bridgeport, WV 26330, upon a nonrefundable payment of ONE HUNDRED ($100.00) DOLLARS, beginning 2nd, October 2024. Check or money order only, made payable to Civil & Environmental Consultants, Inc. Digital files may be accessed at no cost by contacting Civil & Environmental Consultants, Inc. at 304-933-3119 to obtain instructions for accessing and downloading online files.
A two-envelope system will be used. Each must be submitted in a sealed envelope.
Envelope No. I must have the following information presented on the front:
Name and address of Bidder,
“Bid on City of Thomas – 56,000 Gallon Benbush Water Storage Tank,”
Received by City of Thomas, 307 Spruce Street, Thomas, WV 26292.
Envelope No. 2 labeled “Bid Proposal” shall also be placed inside of Envelope #1.
Envelope No. 1 will be opened first and the Bid Opening Requirement items checked for compliance as outlined on the Bid Opening Checklist on page BOR-1 of these contract documents. If such documents are found to be in order, Envelope No. 2 “Bid Proposal,” will then be opened and will be publicly read aloud. If the documents required to be contained in Envelope No. I are not in order, Envelope No. 2 “Bid Proposal” will not be opened and the Bid will be considered non-responsive and will be returned to the Bidder.
A bidder may not withdraw the Bid for a period of ninety (90) days after the date set for the opening of bids.
Bids shall be accompanied by a certified check or bid bond payable to City of Thomas in an amount equal to five percent (5%) of the base bid.
Prospective Bidders should note that this contract will include the following critical requirements as identified in the Contract Documents:
1. Bidders must comply with the Title VI of the Civil Rights Act of 1964, the Copeland Anti-Kickback
Act, and the Contract Works Hours Safety Standards Act.
2. Contractor is required to provide the Drug Free Workplace Certification in accordance with WV Code
21-1D-5.
3. All Bidders are required to have a Class “C”, West Virginia Contractor’s License per Section
§30-42-12 of the West Virginia Code.
Contractor’s Sales Tax Exemption
City of Thomas is exempt from West Virginia Sales Taxes and, by West Virginia Code SSI 1-158d, can now extend this tax exemption to Contractors supplying goods on their behalf. The Contractor shall coordinate with City of Thomas the filing of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid.
DBE Requirements
Each Bidder must fully comply with the requirements, terms, and conditions as set forth in the contract documents to achieve Disadvantaged Business Enterprise (DBE) participation during the performance of this contract. The bidder commits itself to the program for DBE participation and all other requirements, terms, and conditions of the bid conditions by submitting a properly signed bid.
The bidder agrees to make “good faith efforts” to sub-contract a portion of the total value of the contract to Disadvantaged businesses. This shall be done in compliance with the six (6) good faith efforts as outlined in 40 CFR 31.36(e). Failure to demonstrate good faith efforts may lead to rejection of bids. For the purpose of this program, the term “subcontractor” includes all construction, modification, and service work contracted for by the bidder in the execution of the work under this contract.
WV Alcohol and Drug Free Workplace Act
West Virginia Code §21- 1D-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed Drug Free Workplace Conformance Affidavit must be signed and submitted in the first envelope as evidence of the Vendor’s compliance with the provisions of Article ‘l D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug Free Workplace Conformance Affidavit in the first envelope shall result in disqualification of such bid.

A non-mandatory pre-bid conference will be held at 10 A.M. local time on 17th October 2024, at City of Thomas located at 307 Spruce Street, Thomas, WV 26292.
City of Thomas reserves the right to reject any or all bids. Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.
