NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated July 27, 2011, from Braveheart Real Estate, Inc. to Douglas E. Hayes, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1214, at page 661, the undersigned trustee will offer for sale at public auction on March 26, 2019, at 10:00 a.m. at the front door of 307 Federal Street, Bluefield, West Virginia, all that certain tract or parcel of real estate designated as “Lot No. 23 of the Edgemont Addition to the City of Princeton, Mercer County, West Virginia, Scale 1” = 60′, April 5, 1941, by F. E. Walker, Engr., which map is of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, with a deed from Goldie M. Harry, et al, to B. H. Reed and Kate P. Hale, dated August 1, 1945, and recorded in Deed Book No. 273, at page 106, and more particularly bounded and described as follows:

BEGINNING at a point in the eastern line of Edgemont Drive, S. 226′ W. 433.23 feet distant from the point of intersection of the eastern line of Edgemont Drive with the southern line of West Virginia State Highway Route 219, and U. S. Route 460 as existed April 15, 1941, said point being the southwest corner of Lot 24 of said Edgemont Addition; thence along and with the common lot line separating lots 24 and 23, S. 87 34′ E. 146.0 feet to a point, a corner to lots 24, 23, 33 and 34 of said Addition; thence along and with the common lot line separating lots 24 and 23, S. 87 34′ E, 146.0 feet to a point, a corner to lots 24, 23, 33 and 34 of said Addition; thence along and with the western line of lots 34, S. 2 26′ W. 50 feet to an iron pin, a common corner to lots 23, 22, 34 and 35; thence along and with the northern line of lot 22 and said Addition, N. 87 34/ W, 146.0 feet to an iron pin in the eastern line of Edgemont Drive at the northwest corner of lot 22; thence along and with the eastern line of Edgemont Drive, n. 2 26′ E. 50 feet to the point of BEGINNING.

AND BEING the same real estate conveyed unto Braveheart Real Estate, Inc., a West Virginia corporation, by Deed dated June 16, 2011, from Veronica Blevins and Carl Svetlecic, which Deed is intended to be recorded simultaneously herewith.

This conveyance is made subject to those pertinent restrictions, reservations and easements of record.
The deed of trust states that this real estate is located at 111 Foster Street, Princeton, West Virginia.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated February 12, 2019, of record in said Clerk’s Office in Trust Deed Book 1368, at page 508.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
