NOTICE OF SUBSTITUTE TRUSTEE’S SALE
OF PROPERTY LOCATED AT
307 TOWER AVENUE,
RICHLANDS, VIRGINIA

In execution of a Deed Of Trust dated May 6, 2010 and recorded in the Clerk’s Office of the Circuit Court of Tazewell County, Virginia in Deed Book 1074, at page 662, the undersigned Substitute Trustee with full authority and power to act will offer for sale at public auction the following real estate:

All those certain lots or parcels of real estate, with all improvements thereon and all appurtenances thereunto and easements benefiting the same, situate in Tazewell County, Virginia in the Town of Richlands and more particularly designated and described as follows, to-wit:

Parcel No. 1: The remaining portion of Lot 94 as owned by the Grantors, being the northern half of said Lot 94 and all of Lots 70, 75, 76, 77, 95, 96, 97, 98 as shown on that plat entitled “MAP OF SUBDIVISION “A” FLORENCE R. CRABTREE LANDS (PATTON J. BROWN EST.) RICHLANDS, VIRGINIA”, which plat with certificate is of record in the Clerk’s Office of the Circuit Court of Tazewell County in Deed Book 175, at pages 418 and 419, reference to which is hereby made.

Parcel No. 2: A Fifty Foot (50′) wide strip of land, being the northern most Fifty Foot (50′) portion of Lots 90, 91, 92, and 93 and which strip of land adjoins the southern boundary of Lots 95, 96, 97, and 98, together with a strip of land Twenty-Five Feet (25′) wide along the northern part of the remaining portion of Lot 89 as still owned by the Grantors, which Twenty-Five Foot (25′) wide strip of land adjoins and is adjacent to the eastern boundary of Lot 70 and all of which is shown on that plat entitled “MAP OF SUBDIVISION “A” FLORENCE R. CRABTREE LANDS (PATTON J. BROWN EST.) RICHLANDS, VIRGINIA”, which plat with certificate is of record in the aforesaid Clerk’s office in Deed Book 175, at pages 418 and 419, reference to which is hereby made.

This is the same property conveyed unto Robert Andrew Altizer and Christi Celina Altizer by Deed dated September 9, 2009 which is of record in the aforesaid Clerk’s office in Deed Book 1060, at page 955.

Parcel No. 3: All those certain lots, being Lot Nos. 71, 72, 73, and 74 as shown on that plat entitled “MAP OF SUBDIVISION “A” FLORENCE R. CRABTREE LANDS (PATTON J. BROWN EST.) RICHLANDS, VIRGINIA”, which plat with certificate is of record in the Clerk’s Office of the Circuit Court of Tazewell County in Deed Book 175, at pages 418 and 419, respectively.

Parcel No. 4: All that certain tract or parcel of land consisting of a Fifty Foot (50′) wide strip of land adjoining the eastern most boundary of Lots 71, 72, 73, and 74 and being a portion of Lot 89 and Lot 94 and which strip of land is more particularly bounded and described as follows:

BEGINNING at a point situate in the southeast corner of Lot 71 and which point is also in the western most line of Lot 89; thence continuing in a straight line, being the same as the division line between Lots 70 and 71, N. 70 43′ E. 50.00 feet to a point situate in the division line between Lots 89 and 90; thence with the said division line between Lots 89 and 90 and Lots 94 and 95, N. 12 15′ W. 100.00 feet to a point situate in the division line between Lots 94 and 95; thence S. 70 43′ W. 50.00 feet to a point situate in the northeast corner of Lot 74 (being a common corner to Lot 75); thence with the eastern most line of Lots 74, 73, 72, and 71, S. 19 15′ E. 100.00 feet to the point of BEGINNING.

This is the same property conveyed unto Robert Andrew Altizer and Christi Celina Altizer by Deed dated July 20, 2009 which is of record in the aforesaid Clerk’s office in Deed Book 1057, at page 915.

This property is expressly subject to and beneficiary of any and all other reservations, restrictions, and easements of record in the aforesaid Clerk’s Office to the extent that the same may lawfully apply to the property hereby conveyed.

Date of Sale: August 22, 2019
Time of Sale: 8:30 a.m.
Place of Sale: In front of the Main Street Entrance to the Tazewell County Courthouse located on Main Street in the Town of Tazewell, Virginia.
Terms of Sale: Cash. A Ten Percent (10%) Deposit is required from the Successful Bidder at the time of sale with the balance in full within Twenty-One (21) Days.

The foregoing property shall be sold AS IS, WHERE IS and any and all announcements made the day of sale shall take priority over published notices, including postponement of sale and/or withdrawal of the property from sale offer.

It is anticipated that one or more additional properties may be offered for sale on the same day and time and the Substitute Trustee reserves the right to sell all properties separately, as a group, or in combinations thereof in his sole discretion.

The Successful Bidder shall be required to sign a Memorandum Of Agreement at the time of sale which sets forth other terms of sale.
