TO: Ricky Dean Dawson, Father of X. Legg, Child.
(The object of this Action is to notify Ricky Dean Dawson, the adult respondent father of a Child Abuse and Neglect Petition herein filed so that said Ricky Dean Dawson, adult respondent father may Answer the same and appear in the Circuit Court of Clay County, West Virginia, to protect his interest).
You are hereby notified that a Child Abuse and Neglect and/or
Abandonment Petition has been filed with the Circuit Court of
Clay County, West Virginia, on the 2nd day of November, 2020,
and assigned case number 20-JA-35, wherein it is alleged that
the natural father of the child X. Legg (Date of Birth September
13, 2007) is Ricky Dean Dawson, and that the mother of the
child X. Legg is Jessica Stone, who resides in Clay County, West
Virginia, and that said Child was placed in the physical and legal
custody of the West Virginia Department of Health and Human
Resources (WVDHHR) on the 2nd day of November 2020, with
said child remaining in the care, custody, and control of the
WVDHHR since that time in accordance with W.Va. Code §49-6-
201. You are hereby notified that you have the right to Answer said
Petition and you have the right to have counsel present at all stages
of the proceedings and ALL PROCEEDINGS CAN RESULT IN
THE PERMANENT TERMINATION OF CUSTODIAL AND
PARENTAL RIGHTS TO SAID INFANT CHILD. An Adjudica-
tory Hearing on these matters has been scheduled in the Circuit
Court of Clay County, West Virginia, to take up the Petition filed
by the State of West Virginia on the 8th day of January, 2021 at
9:00 a.m., and that Ricky Dean Dawson shall appear in the Circuit
Court of Clay County, West Virginia, 246 Main Street, Clay, West
Virginia, at that time to be heard.
Accordingly, it is Ordered that Ricky Dean Dawson the natural
father of the infant respondent X. Legg appear and serve upon
Jim E. Samples, Prosecuting Attorney of Clay County, West
Virginia, Petitioner’s attorney, whose address is P.O. Box 25,
Clay, WV 25043, an Answer or other defense to the Petition filed
in this action within 20 days from the date of this publication,
otherwise Judgment by Default will be taken against them at any
time thereafter, and termination of your custodial and parental
rights may be ordered by the Court.
A copy of said Petition can be obtained from the Office of the
Circuit Clerk of Clay County, West Virginia at the Clay County
Courthouse, Clay, West Virginia.
