ORDER OF PUBLICATION
This action seeks condemnation of property located in the Town of Alderson in Greenbrier County, West Virginia (“Subject Property”), pursuant to West Virginia Code, Section 54-1-1 et seq., which Jennie Kennedy died seized intestate and being the tract of land containing 0.125 acres, more or less, situate in Alderson Corp. District, Greenbrier County, West Virginia, and being the property described by deed dated April 18, 1906, from G.S. Alderson and Dolly M., his wife, and J.M. Anderson and Florence H., his wife, to Mrs. Jennie Kennedy, and recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed 72, at Page 559, and is further identified in the Greenbrier County Assessor’s Office as Alderson Corp. District, Tax Map 5, Parcel 244 (Lot 116).
It appearing by affidavit filed in this action that Petitioner Town of  Alderson has execrised due diligence to ascertain the residence and whereabouts of all known heirs of Jennie Kennedy regarding the Subject Property, and that there may be persons, other than those named in the Petitioner for Condemnation and Right of Entry as defendants with an interest in the Subject Property of the action, and who may be made defendants, it is hereby ORDERED that any and all parties who claim an interest in the Subject Property must appear and serve upon Petitioner Town of Alderson’s counsel, William J. O’Brien and Lauren K. Turner of the law firm of Steptoe & Johnson PLLC, whose address is 400 White Oaks Boulevard, Bridgeport, WV 26330, an answer or other defense to the Petitioner for Condemnation and Right of Entry filed in this action by April 7, 2016, which is not fewer than thirty (30) days after the date of first publication of this notice, otherwise judgment by default will be rendered against him or her at any time thereafter.
A copy of the Petitioner for Condemnation and Right of Entry can be obtained from the Circuit Clerk’s office in the Greenbrier County Courthouse located at 912 Court Street North, Lewisburg, WV 24901.
