ORDER OF PUBLICATION

A Petition to Construe the Last Will and Testament of Betty J. Lamp, deceased, has been filed by Petitioner, Janet M. Sherrard, as the Adminstratrix, c.t.a., of the Estate of Betty J. Lamp, deceased, Case No. 14-P-89, in the Circuit Court of Jefferson County, West Virginia. The Petitioner is represented by Catherine A. Delligatti and Amy R. Lamp Leonard, of Bowles Rice LLP.

The object of this Petition is for the Court to provide clarity to the Admistratrix and permit her to complete the administration of the Estate, providing direction regarding whether the real estate passes according to the terms of the Will or as if the Testatrix died intestate, and direction regarding whether a “small portion” of assets is to be distributed to persons named in the Will, and if so, which assets are to be distributed.

It appearing by an affidavit filed in this action that the Petitioner has utilized due diligence to ascertain the residence or whereabouts of the following Respondents: Bob LeDane, Kristen LeDane, Rhonda Pepple, Rick Anderson, Connie Whitacre, Raymond Turner, Glenn Hess, Randall Hess, Brenda Hess Paul, Ernest Grove, Tony Jackson, Robert Carter, Stephen Dodson, Ryan C. Oates, Timothy W. Carter, Terry Strosnider-Stickles, Roxanne Garrett Steele, Marvin LeDane, Sherry Lynn Anderson, Paula LeBorious, Bryan Kent LeDane, and Dwight David LeDane are hereby given notice to appear and serve upon Petitioner’s counsel, Catherine A. Delligatti and Amy R. Lamp Leonard, of Bowles Rice LLP, whose mailing address is Post Office Drawer 1419, Martinsburg, West Virginia, 25402-1419, an answer or other defense to the Petition to Construe the Last Will and Testament of Betty J. Lamp, deceased, filed in this action within thirty (30) days after the date of first publication of this notice. Otherwise, the prayer of said Petition may be granted.

By Order of the Circuit Court, this matter has been set down for a hearing on the 23rd day of March, 2015, at the hour of 3:00 p.m. at the Jefferson County Courthouse, 100 East Washington Street, Charles Town, West Virginia 25414, during which the Court shall consider the allegations set forth in the Petition filed in the above-styled Civil Action and the relief requested therein. All persons who may have an interest in the subject matter of the above-styled Civil Action are invited to appear on that date and protect their interests.

A copy of the Petition to Construe the Last Will and Testament of Betty J. Lamp, deceased, is available for inspection and copying in the Office of the Clerk of the Circuit Court of Jefferson County, West Virginia.
