TO LARRY HASH, HIS HEIRS, SUCCESSORS OR ASSIGNS OR ANY OTHER PERSON OR ENTITY HAVING INTEREST IN THE REAL ESTATE DESCRIBED BELOW:
You are hereby notified that a petition for partition of real estate has been filed in the Circuit Court of Clay County, West Virginia, in the above-styled action which prays for an order of the Court directing the sale of the hereafter described property. You are hereby notified that all persons having a claim upon said property, either as owner, lien holder, or holder of a security interest, have a right to file such claim clearly stating the identity of the claimant; the nature of the claim; and an address where the claimant can be served with legal process. Such claim must be filed in writing and sent to Bailey, Javins & Carter, Attn: Jasmine R. H. Morton at 704 Professional Park Drive, Summersville, West Virginia 26651.
1. The property in question in this action is described as follows:
BEGINNING at a stake in the southerly right of way line of said State Route No. 4 also a corner to a lot formerly owned by Fred F. Rucker, the Rucker lot being No. 2 of the land whereof that hereby conveyed was a part, and running thence with said right of way line S. 65 E., 82.5 feet to a stake in said right of way line over the center of a culvert under said State Route No. 4; thence S. 19 1/2 W., 49.5 feet to a stake on the north band of said Elk River; thence down said river with its meanders N. 69 W., 82.5 feet to a stake on the bank of said river, also a corner to said Rucker lot; thence leaving said river and running with one line of said Rucker lot reversed N 19 1/2 E, 57.75 feet to the place of the beginning, containing 16 rods, more or less.
And being the same real estate whereby Clarence E. Adamson and Ernestine K. Adamson, his wife, conveyed unto Russell Hash, single, all right, title and interest, by deed dated June 28, 1973, of record in the Office of the Clerk of the County Commission of Clay County, West Virginia in Deed Book 109 at Page 160.
You are hereby notified you have the right to file an answer to this petition, setting forth your title in, and right to possession of, the property, within thirty (30) days of this order and notice. If you fail to file an answer, a final order issuing the sale of the property will be entered, and such order is not subject to appeal.
