The Object of this proceeding to obtain an Order from the Court to equitably reform the Deed of Trust dated March 26, 2004 and recorded April 22, 2004 to (1) apply the principle of equitable subrogation to the Deed of Trust such that Deed of Trust has the first-priority position on the Property; (2) declare the assignment of the Deed of Trust from Washington Mutual Bank, FA to Citibank, N.A. as valid; (3) declare that the Deed of Trust retains priority as of its date of filing; and (4) direct the Clerk’s Office accept and record a certified copy of an Order to provide notice of the judgment granted. A copy of the Complaint may be obtained from the office of the Clerk of the Circuit Court of Tucker County, West Virginia, 211 First Street, Suite 403, Parsons, West Virginia. You must appear and defend yourself on or before thirty (30) days from the date of this publication, by filing with the Clerk of Tucker County Circuit Court a written response to the Complaint filed against you. You should mail a copy of your written response to counsel for the Plaintiff, Briana J. Marino, Esq., Babst Calland, P.C., 500 Virginia Street, East, Suite 590, Charleston, WV 25301. If you do not appear and defend yourself in this case, judgment by default will be taken against you.
