NOTICE OF SALE AT
PUBLIC AUCTION

Please take notice that by virtue of an Order of the Circuit Court of Fayette County, West Virginia, entered on April 23, 2019, and by virtue of the authority vested in the undersigned Special Commissioner by said Order, the undersigned Special Commissioner will on March 10, 2020 at 11:00 a.m. sell to the highest bidder at Public Auction at the Fayette County Courthouse, 100 Court Street, Fayetteville, West Virginia, the following described tracts or parcels of land, together with improvements thereon, appurtenances thereunto belonging, rights incidental thereto, situate in New Haven District, Fayette County, West Virginia, and being more particularly bounded and described as follows:

FIRST TRACT: BEGINNING at a fence post, corner to Lot No. 8, on Central Avenue; thence running with the same N 77-00 E 172.0 feet to a corner of the 0.15 acre lot conveyed to Earnest W. and Ruby P. Sorrels; thence running with the same S 34-00 E 131.5 feet to a corner to the same, on line of Lots 6 and 7; thence running with said line S 56-00 W 160.0 feet to a corner to said lots on Fair Acres Drive; thence running with the same, passing the corner to Lots 7 and 8 at 75.0 feet, a total distance of 195.0 feet to the beginning, containing (0.60) six-tenths of an acre, more or less, (being the remainder of Lots 7 and 8).

SECOND TRACT: BEGINNING at the corner of Lots Nos. 4 and 5 on Fair Acres Drive; thence running with the same N 34-00 W 150.0 feet to the corner to Lots 6 and 7; thence N 56-00 E 50.5 feet to a post in line of said lots; thence leaving Lot No. 7 with a new line through Lots Nos. 6 and 5 S 35-45 E 150.0 feet to a post in line of Lots 4 and 5; thence running with the same S 56-00 W 56.0 feet to the beginning, containing (0.20) two-tenths of an acre, more or less, and being a part of Lots Nos. 5 and 6 of Fair Acres Subdivision at Danese, West Virginia.

The above described real estate will be sold by the undersigned Special Commissioner by auction to the highest bidder.
Terms of the sale are cash or certified funds in hand from the highest bidder at the time of sale or by 5:00 p.m. on the day of sale at the office of the Special Commissioner, Philip J. Tissue, 303 Jones Avenue, Oak Hill, West Virginia.
The undersigned Special Commissioner reserves the right to continue such sale or to reschedule the same by posting on the front door of said Courthouse a Notice of such continuance and new date and time and posting an additional Notice thereof in the hallway of the Fayette County Courthouse.
Said real estate will be sold “As Is” without any warranty by said Special Commissioner as to the title to this property and without any warranty as to the mechanical, electrical, plumbing and structural components of the premises and without any warranties or representations as to the contamination or lack of contamination to the surface, substrata, or the premises of hazardous substances and/or petroleum and related by-products, hydrocarbons, radon, asbestos, urea formaldehyde and polychlorinated biphenyl compounds.
The Special Commissioner shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
This sale is made and accepted subject to all validly continuing reservations, restrictions, covenants, conditions rights-of-way and easements made or contained in all prior deeds in the chain of title to the real estate herein conveyed.
Said real estate will be sold subject to any and all taxes, assessments and liens for taxes, if any.
The subject property is situate in New Haven District, Fayette County, West Virginia and is listed on the land books of Fayette County in said district in the name of Gloria L. Martin in Tax Map 102M , Parcel 0024.
