NOTICE OF PROPOSED CONVEYANCE
OF UNITED METHODIST CHURCH PROPERTY
(Burke Memorial United Methodist Church)
Notice is hereby given that the Board of Trustees of the West Virginia Annual Conference of the United Methodist Church will, on or after December 5, 2019, QUITCLAIM, GRANT and CONVEY to Trustees of Burke Community Church, all of their right, title and interest, in and to the following described lots or parcels of land, situate on the South side of Elk River, in Union District, Clay County, West Virginia, and bounded and further described as follows, to-wit:
PARCEL ONE:
BEGINNING at the northeast corner of the church lot of second party and in line of land of first parties
obtained by them of Lillian Virginia Brigade, and running thence with said line North 46 degrees and 37
minutes west, 14 feet to a stake in said line; and thence at rights angles South 40 degrees and 57 minutes
West, 47 feet to a sake; and thence at right angles South 46 degrees and 37 minutes East, 14 feet to the
Northwest corner of said church property; and thence North 40 degrees and 57 minutes East, 47 feet and
with the northern line of said church property to the place of beginning.
And being the same property conveyed to Trustees of Burk’s Memorial Methodist Church, by Deed dated June 27, 1957, from W. B. White and Betty White, his wife, and of record in the Office of the Clerk of the County Commission of Clay County, West Virginia in Deed Book 80, at page 305.
PARCEL TWO:
BEGINNING at a No. 5 rebar set at a corner common with the right of way line of the B & O Railroad,
and property now owned by Burke Memorial United Methodist Church; thence S. 40° 54’ W. 73.62 feet
to a No. 5 Rebar set in said right of way line, and being a corner common with property of which this
conveyance is a part; thence N. 49° 54’ W. approximately 162.45 feet to the edge of Elk River, said edge
of Elk River being approximately 18 feet from a No. 5 rebar set in this line; thence up Elk River N. 38°
24’ E. 73.65 feet; thence S. 49° 54’ E. approximately 165.67 feet, the last 85 feet approximately common
with property now owned by said Church, to the place of beginning, containing 0.277 acres, and being
that parcel of land shown on that certain map prepared by William R. Gunnoe, L.L.S., dated July 5, 1968,
for the parties of the First Part herein.
And being the same property conveyed to Randy Leo White, Superintendent, Garland R. Tenny, Lay Speaker and the People of the Burke Memorial Church, by Deed dated July 7, 1988 from Garrett D. Samples, Sr., and Phylis June Samples, his wife, and of record in the aforesaid Clerk’s Office in Deed Book 14 7, at page 145.
PARCEL THREE:
BEGINNING at a stake at the railroad right-of-way, at the upper corner of a 100 foot lot formerly owned
by W. C. Reed, and running with line of said Reed lot N. 40 degrees and 37 minutes W., 70 feet to a stake
in said deed line; thence W. 40 degrees and 57 minutes E. 47 feet to a stake; thence in a southeasterly
direction and parallel with the first mentioned line back to said railroad right-of-way; and thence with
said road right-of-way S. 45 degrees and 49 minutes W., 47 feet to the point of beginning.
And being the same property conveyed to Trustees for and of the Methodist Church, by Deed dated June 30, 1947, from H. L. Foreman and Martha Foreman, his wife, and of record in the aforesaid Clerk’s Office in Deed Book 56, at page 237.
Said Burke Memorial United Methodist Church having been closed by the regular 2019 session of the West Virginia Annual Conference of the United Methodist Church.
