NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated September 1, 2015, from Danny L. Wellman, II and Crystal A. Wellman to Gary R. Mills, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1302, at page 501, the undersigned trustee will offer for sale at public auction on June 7, 2018, at 10:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, all of the following described real estate, situate in the City of Bluefield, Mercer County, West Virginia, known ad designated as Lot 9-A, Section 866, on Fairmont Street in said City, being a subdivision of Lot 9, Section 866, and fronting 51.7 feet on said Fairmont Street in said city, to wit:

BEGINNING at a point in the south line of Fairmont Street, at the northeast corner of a lot heretofore conveyed to Herman Bowles; thence N. 44o 56′ E. and with the south line of Fairmont Street 51.7 feet to a point at the intersection of said line of Fairmont Street with the west line of a 20 feet wide alley; thence with the west line of said alley S. 45o 04′ E. 338.4 feet to a point; thence S. 73o 50′ W. 49.4 feet to a point; thence N. 46o 33′ W. 314.8 feet to the BEGINNING.

AND BEING the same real estate conveyed unto the Part of the First Part herein by deed dated August 19, 2015, from Jason W. Worley and Sarah D. Worley, husband and wife, which deed is intended to be recorded simultaneously herewith.

This conveyance is made subject to all exceptions, reservations, conditions, restrictions, and easements in prior deeds in the chain of title of said property.

The deed of trust states that the address of this real estate is 513 Fairmont Street, Bluefield, West Virginia.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated May 8, 2018, of record in said Clerk’s Office in Trust Deed Book 1354, at page 677.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be a deed without warranty. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
