DEP Permit No WV1013882

Notice is hereby given that Fola Coal Company, LLC, PO BOX 180, 2112 Leatherwood Rd, Bickmore, WV 25019 has submitted an application for the modification of Article 11/WVNPDES Permit No. WV 1013882 to the Department of Environmental Protection, 47 School Street, Suite 301, Philippi, WV 26416-1150 in order to add a new Article 3 Permit (S201012), and its associated outlets (002-009 and 101) and associated downstream monitoring station. Permit will also revise existing valley fill and add Narrative Water Quality Standards Policy to newly added outlet 101. As a result, BAS monitoring, and WET limits will be required for outlet 101 once the new activity begins that would require WET testing and NWQS monitoring.
The operation will discharge treated storm water into Franks Branch of Lilly Fork and Lilly Fork of Buffalo Creek of Elk River and is located 4.6 miles, northeast of Bickmore, in Henry District of Clay County, Longitude 81o 01’ 08” and Latitude 38o 22’ 52” (Coordinates from USGS Topographic Map).
The Department of Environmental Protection is seeking information on private surface water intakes for human consumption located in the above listed receiving streams and located down stream of this operation. Please provide your name, phone number, mailing address, the name of the stream being with the intake, and the physical location of the intake. This information needs to be submitted to the address above.
An anti-degradation review has been conducted. Tier 1 protection is afforded because effluent limitations ensure compliance with water quality criteria for all designated uses. Where applicable, Tier 2 protection is also afforded because the agency has made a determination that the discharge(s) will not cause significant degradation to the receiving stream(s) for any parameters of concern.
