Pursuant to the authority vested in the undersigned by Credit Line Deed of Trust dated the 23rd day of May, 2014, executed by Derrick A. Thompson, unto Harold B. Wolfe, III, Substitute Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1275 at Page 513, and the undersigned, Harold B. Wolfe, III, have been requested to do so by the beneficiary, and default having been made under the terms and conditions of said Credit Line Deed of Trust, and the provision in said Credit Line Deed of Trust concerning acceleration having been compiled with by the beneficiary and present holder of the Note, said Trustee will sell at public auction at 10:00 a.m. on the 13th day of September, 2018, at the front doors of the Courthouse of Mercer County, West Virginia, the following described property, to-wit:

” … all of that certain tract or parcel ofreal estate designated as Lot 30 on ‘PLAT SHOWING VALLEY VIEW ESTATES NO. II – PHASE II
LYING ON THE WATERS OF BRUSH CREEK OF BLUESTONE RIVER BEAVER POND DISTRICT – MERCER COUNTY SITUATE FOUR MILES SOUTHWEST OF PRINCETON GREEN VALLEY – WEST VIRGINIA SCALE 1″ = 150′ June of 1998 /s/ A.M. Shields, III, Shields Engineering Co. LLC’, said plat now recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 15441, and being more particularly bounded and described as follows:

“BEGINNING at a point in the centerline of High Plains Drive, said point being the southeast comer of Lot 29; thence with the division line between Lot 29 and Lot 30, N. 11 0 23′ 05″ E. 461.07 feet to a 1/2 inch rebar set; thence N. 770 01′ 13″ E. 150.06 feet to a 1/2 inch rebar set; thence S. 11o 23′ 59” W. 151.62 feet to the point of BEGINNING, and containing 1.56 acres, more or less.

And being the same property conveyed unto Derrick A. Thompson from TG & G Enterprises, LLC, by deed dated the 4th day of April, 2013, of record in the office of the
Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 988 at Page 367.

“This conveyance is made expressly subject to a Declaration of Protective Covenants, Restrictions and Reservations to Lots and Tract in Valley View Estates, filed for record in said Clerk’s Office in Deed Book 749, at Page 36.

“There is expressly excepted and reserved from this conveyance rights of others in and to so much of the right-of-way known as High Plains Drive, as shown upon the aforesaid plat, as is contained in the above description.

“This conveyance is expressly made subject to and benefitted by all covenants, restrictions, reservations, conditions, easements and rights-of-way of record.”

This Deed of Trust shall be junior in dignity and priority to a Deed of Trust dated April 8, 2003, unto Mike Day and Thomas S. Lilly, Trustees, securing MCNB Bank & Trust Company, recorded in Trust Deed Book 1253 at Page 481 . A default in either of these Deeds of Trust shall be deemed a default in both.

It is the intention of this Notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

The above described real estate is reported to have a physical address at 251 High Plains Drive, Princeton, Mercer County, West Virginia, 24739.

This sale will also be made subject to any and easements heretofore granted by predecessors in title; and subject further to any and all unpaid real property taxes and unpaid assessments, the purchaser assuming payment thereof.

The owners and holders of said Note reserving the right to enter a bid at said sale and the right to reject any and all bids.

The Trustee reserves the right to reject any and all bids.

TERMS OF SALE: Cash in hand on the day of sale, or upon terms to be agreed upon between Trustee and successful bidder; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title to this property.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a Notice of same where legal notices are posted for this county. Should the Trustee not appear at the time appointed for the sale and there is no Notice posted of a continuance, please ~ontact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated gent to sell said property as Trustee by instrument to be recorded.
