NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated October 22, 2008, from Eleanor Chambers to Douglas Hayes, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1153, at page 521, the undersigned trustee will offer for sale at public auction on January 22, 2019, at 10:00 a.m. at the front door of 307 Federal Street, Bluefield, West Virginia, all those certain tracts or parcels of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, situate in Rock District, Mercer County, West Virginia, which property is more particularly bounded and described as follows:

Parcel 1: The surface of that parcel of real estate as shown on plat entitled “MAP SHOWING PARCELS 120 & 121 TAX MAP 54 ROUTE 52 ROCK DIST. MERCER CO., WV” prepared by Appalachian Engineering & Surveying, Inc., dated 8/4/95, revised 11/29/95, 12/5/95 and 12/12/96,” which plat is recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 15898, and which property is more particularly bounded and described as follows:

BEGINNING at a point in the west right of way of U. S. Route 52 being the northeast corner of the property herein conveyed, and thence from said point of Beginning, S. 26 16′ W. 64.17 feet to a point; thence N. 72 47′ W. 85.68 feet to a point; thence N. 74 06′ W. 88.13 feet to a point; thence N. 82 57′ W. 16.81 feet to a point; thence N. 19 35′ E. 61.90 feet to an iron bar; thence N. 26 47′ 40″ E. 49.17 feet to a rebar; thence with the right of way of U.S. Route 52, S. 66 13′ E. 95.27 feet to a point; thence S. 54 40′ E. 100.02 feet to the point of BEGINNING, and containing 0.40 acre, more or less.

Parcel 2: All that strip, piece or parcel of land situate, lying and being in Rock District, Mercer County, West Virginia, and being more particularly described and shown as Tract B on a plat prepared by William J. Looney, West Virginia Licensed Surveyor No. 1131, titled “MAP SHOWING PARCELS 120 & 121 TAX MAP 54 ROUTE 52 ROCK DIST. MERCER CO., WV” prepared by Appalachian Engineering & Surveying, Inc., dated August 4, 1995, last revised December 12, 1996, being Railroad Drawing No. RB-2000-45, dated March 15, 2000, which map is of record as aforesaid at Microfilm Plat No. 15898.

AND BEING the same real estate conveyed unto Eleanor Chambers by Deed of Tina Long (formerly Tina Lambert) dated February 22, 2007, and of record in said Clerk’s Office in Deed Book 907, at page 570.

The above real estate is subject to those easements of record including the right to use any road on the adjoining lands of Pocahontas Land Corporation; the right to drill wells for water on the surface of said land of Pocahontas Land Corporation for access; and the right of Easter Thornton, et al, to obtain water from the present source of supply of the house now located on the surface of the land but without warranty as to quantity or quality of the source of supply.

The deed of trust states that this real estate is located at 8937 Coal Hertiage Road, Bramwell, West Virginia.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated December 14, 2018, of record in said Clerk’s Office in Trust Deed Book 1366, at page 95.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE:
Cash in hand on day of sale. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
