The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 5, 2013, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 923, at Page 236, Earl W. Bowen did convey unto Otis L. O’Connor, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Montgomery District, Fayette County, West Virginia, and more particularly described as follows:
BEING the surface only of that certain parcel or tact of real estate located in the Montgomery District, Fayette County, West Virginia and is more particularly described as follows:
BEGINNING at a cross mark on the walk on the North side of Fifth Avenue in the City of Montgomery, Fayette County, W. Va., being a common corner with the Drasnin lot, thence N 72 48′ W with said Fifth Avenue 36.97 feet to a pin, a common corner between Lot B and Lot C; thence, N 21 50′ E 170.77 feet more or less to the Kanawha River, along the common boundary line between Lot B and Lot C, and passing through a pin on said line 87.65 feet from and North of the pin on said line; thence, up and with the meanderings of the Kanawha River in a generally Southeastern direction a distance of 23.5 feet more or less to a point, being a common corner to the Drasnin lot; thence leaving the Kanawha River, S 17 15′ W 162.91 feet more or less to the BEGINNING, along the common boundary line between Lot C and Drasnin and passing through a pin on said line at 77 feet more or less from the Kanawha River; and being Lot C as shown on a map entitles “Koester Colville and Frances Landon Subdivision of the Reside of the Lena Colville Estate, Fifth Avenue, Montgomery, Fayette Co., W.Va.,” Scale 1″ = 20′, dated March 30, 1963, as prepared by W.R. Wise, R.P.E. No. 2583, which map is of record in the Office of the Clerk of the Fayette County Commission, Fayetteville, West Virginia.
There is further hereby conveyed such additional land on the rear of the property as may have been created by the general fill of the area at the time the present Montgomery bridge was constructed, it being the intention hereby to also convey any newly created land as may now exist on the rear of the property by an extension of the side lines of the property to the present low water mark of the Kanawha River.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 110 5th Avenue, Montgomery, WV 25136.
AND BEING the same real estate which was conveyed to Earl W. Bowen and Dolores Ann Bowen by Deed dated May 6, 1983, from Adrienne Thompson, and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 416, at Page 417. Dolores Ann Bowen passed away from this life on November 29, 2010 and title vested in Earl W. Bowen.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
