REAL ESTATE BY
SPECIAL COMMISSIONER

Pursuant to an Order of the Circuit Court of Fayette County, West Virginia, entered on April 18, 2017, in a case styled Eugene Logan v. Wilbert McCormick, et als, Civil Action No. 16-C-70, Philip J. Tissue, the undersigned Special Commissioner, will offer for sale at the location site of the real estate to be sold at Shamrock Lane, Hilltop, West Virginia at Public Auction, to the highest bidder on

1:30 p.m.

the following described lot or parcel of land, together with improvements thereon, appurtenances thereunto belonging and rights incidental thereto, situate at Shamrock Lane, Hilltop, Fayette County, West Virginia, and being more particularly designated and described as follows:
Lot No. 14 of the Rostock Addition to the Town of Hilltop, Plateau District, Fayette County, West Virginia, as shown on a map or plat of Rostock, of record in the Fayette County Commission Clerk’s Office in Map Book 1, at Page 147.
The above described real estate will be sold by the undersigned Special Commissioner by auction to the highest bidder, subject to a minimum bid of Twenty Thousand Dollars ($20,000.00).
Terms of the sale are cash or certified funds in hand from the highest bidder or a ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) deposit with the balance paid within thirty (30) days or a letter of credit from a financial institution with an office in Fayette County, West Virginia, insuring such bid with the balance due and payable within thirty (30) days.
The undersigned Special Commissioner reserves the right to continue such sale or to reschedule the same by posting on the front door of the house and lot to be sold a Notice of such continuance and new date and time or making an announcement to that effect at the date and time of the scheduled sale.
Said real estate will be sold “As Is” without any warranty by said Special Commissioner as to the title to this property and without any warranty as to the mechanical, electrical, plumbing and structural components of the premises and without any warranties or representations as to the contamination or lack of contamination to the surface, substrata, or the premises of hazardous substances and/or petroleum and related by-products, hydrocarbons, radon, asbestos, urea formaldehyde and polychlorinated biphenyl compounds.
The Special Commissioner shall be under no duty to cause any existing tenant or person, if any, occupying the subject property to vacate said property.
This sale is made and accepted subject to all validly continuing reservations, restrictions, covenants, conditions rights-of-way and easements made or contained in all prior deeds in the chain of title to the real estate herein conveyed.
Said real estate will be sold subject to any and all taxes, assessments and liens for taxes, if any.
The subject property is situate in Plateau District, Fayette County, West Virginia and is listed on the land books of Fayette County in said district in the name of Plateau, on Tax Map 38E, Parcel 24.
