ADOPTION OF THE FAYETTE
COUNTY COMPREHENSIVE
PUBLIC NUISANCE
ABATEMENT ORDINANCE

On Tuesday, July 24, 2018, County Commission, Fayette County, West Virginia gave notice to the public on the County Commission’s regularly maintained and published County Commission webpage,

and by posting at the Fayette County Courthouse that the Fayette County Commission would consider at its regularly scheduled meeting on July 27, 2018 at the County Commission’s chambers at the Fayette County Courthouse in Fayetteville, WV, the introduction of the proposed FAYETTE COUNTY COMPREHENSIVE PUBLIC NUISANCE ABATEMENT ORDINANCE for consideration by the County Commission, and the opening of a period of public comment on the proposed ordinance. PLEASE TAKE NOTICE THAT AT ITS REGULAR SESSION ON JULY 27, 2018, THE FAYETTE COUNTY COMMISSION WILL TAKE UP THE QUESTION OF INTRODUCING FOR CONSIDERATION THE ADOPTION BY THE FAYETTE’ COUNTY COMMISSION OF A PROPOSED ” FAYETTE COUNTY COMPREHENSIVE PUBLIC NUISANCE ABATEMENT ORDINANCE.”
This proposed ordinance would by establishing definitions, declarations, prohibitions and procedures: (1) declare designated acts or conditions that endanger the public health, safety, welfare, or the environment to be a public nuisance; (2) prohibit creating, causing, contributing to, or maintaining any declared public nuisance in Fayette County; (3) establish procedures for investigating and abating any public nuisance within or adversely effecting Fayette County, West Virginia; (4) prohibit as a public nuisance the disposal of “designated hazardous wastes” and “prohibited hazardous substances” at any place within Fayette County; (5) declare the existence of any permanent land disposal of any such hazardous wastes or “prohibited hazardous substances” at any unpermitted place within Fayette County to be a public nuisance; (6) provide definitions; (7) declare legislative intent; (8) provide for certain exemptions; (9) provide for methods and procedures of investigation, enforcement, and abatement of public nuisances and any imminent and substantial endangerment to the public health, safety, welfare or the environment within Fayette County; (10) establish liability for, and provide procedures for recovery of, public nuisance abatement action costs incurred or to be incurred by Fayette County from a person liable for the public nuisance act or condition; (11)establish limited reporting and document retention requirements; (12) provide for civil and criminal penalties and establish certain affirmative defenses to civil and criminal liability under the proposed ordinance; and (13) provide an effective date.
PLEASE TAKE FURTHER NOTICE that the Fayette County Commission has scheduled two (2) separate future public hearings before the Fayette County Commission to receive public comment on the proposed ordinance. The public hearings to receive public comment on the proposed ordinance have been scheduled to commence at 10:00 a.m. on August 3, 2018 and at 10:00 a.m. on August 17, 2018. Both public hearings will take place at the County Commission chambers, Fayette County Courthouse, Fayette County, WV. The public may view the proposed ordinance on the Fayette County Commission’s above-identified public webpage and copies of the proposed ordinance may be obtained at the office of the Fayette County Clerk, Fayette County Courthouse, Fayetteville, WV. The office of the Fayette County Clerk may be contacted by telephone at 304-574-4290. Notice to the public of the first of these public hearings to receive public comment on the proposed ordinance was provided on the County Commission’s regularly maintained and published meeting’s agenda website on July 27, 2018.
