NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 15, 2015, executed by Borrowers, Brian M Harris and Rebecca L Harris, to Reltco Inc., the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1305, at Page 614. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 318 Green Acres Loop, Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 23, 2018, of record in the Clerk’s Office in Book 1351, Page 132. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

27th day of February, 2019
at 11:15 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Plymouth District, Mercer County, West Virginia, and being more particularly described as follows:

PARCEL ONE
All that certain tract or parcel of real estate designated as Lot 12 Section C, as shown upon Microfilm Plat No. 9558, which Map bears the legend, “Map Showing Survey for Ralph L. Kiblinger & Nelma G. Kiblinger, Situate in Green Acres S/D 4 Miles East of Princeton, Plymouth District Mercer County, West Virginia dated 4-22-87, Scale 1″ = 50′, James E. Wentz, L.L.S.” and which said Lot is more particularly bounded and described as follows:
Beginning at a pipe set in the western line of a 30′ Service Road, said point being the southern corner of Lot 12, Section C herein conveyed and the eastern corner of Lot 11, Section C; thence with the dividing line between said Lots 11 and 12, N. 33 degrees 45′ W. 100.00 feet to a point, being the common corner of Lots 11, 19, 20 and 12; thence with the dividing line between Lots 12 and 20, N. 41 degrees 25′ E. 99.80 feet to a point; thence S. 33 degrees 52′ E. 99.95 feet to a point in the western line of said 30′ Service Road; thence along and with said 30′ Service Road, South 41 degrees 25′ W. 100.00 feet to the point of beginning and containing 0.222 acres, more or less.
PARCEL TWO
All of that certain parcel of land located in Plymouth District, Mercer County, West Virginia, and as shown upon a map thereof which bears the legend ‘Map Showing a Parcel of Land to be Conveyed to Jimmy Charles Bailey and Brenda Lee Bailey, his wife, by: Ralph L. and Nelma G. Kiblinger, Situate in Plymouth District, Mercer County, W. Va., Drawn 10-28-77,” recorded as Plat No. 6566, and more particularly bounded and described as follows:
Beginning at an iron rod on the south-side of a 40’ ft service road, a common corner of lot 19-Section ‘C’ thence with said road N. 39 degrees 00′ E-101′ ft to an iron pipe, a common corner of lot 21-Section’C’ thence running with line of lot 21 S 33 degrees 45′ E-104.1 ft to an iron pipe, a common corner of lots 12-13 and 21 Section ‘C’, thence with line of lot 12- S 41 degrees 25′ W- 100′ ft to an iron rod a common comer of lots 11-12 and 19 Section ‘C’ then with line of lot 19-N 33 degrees 45′ W-100.1 ft to the point of beginning and containing 0.23 of an acre (23/100 ac) more or less and to be known as Lot 20- Section ‘C’ as shown on map drawn October 28, 1977- Scale 1″ = 50′ and map drawn April 9th, 1975- Scale 1″= 100′.

Being the same property conveyed to Brian M Harris and Rebecca L Harris by the Deed dated December 6, 2013 and recorded in Deed Book 1000 at Page 380 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
