NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 25, 2003, executed by Borrowers, Keith Bailey and Karen C Payne, to Harold Brewster, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 976, at Page 590. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 120 Boxwood Cir, Princeton, WV 24740. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 5, 2018, of record in the Clerk’s Office in Book 1351, Page 560. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Beaver Pond District, Mercer County, West Virginia, and being more particularly described as follows:

All that certain lot or parcel of land, situate in Beaver Pond District, Mercer County, West Virginia, designated as Lot 31 on a plat bearing the legend, “MAP OF SURVEY FOR LOT 31 OAKLAND TERRACE SURVEYED FOR DON D. & LUCINDA LAMBERT BEAVER POND DISTRICT, MERCER CO. W.V. OCT 18, 1986 SCALE 1″ = 20′,” of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm #9432, and which said Lot 31 is more particularly bounded and described as follows:

BEGINNING at a point in the East line of White Oak Circle, at the common corner of Lots 31 and 33, as shown upon said Map; thence with the eastern line of White Oak Circle, N. 31deg. 11′ W. 69.23 feet to a point at the intersection of the East line of White Oak Circle with the southerly line of Oakland Drive; thence with the curve of Oakland Drive on a radius of 20.48 feet for 39.50 feet (Chord = 33.65 feet, N. 24deg. 05′ E.); thence continuing with the southerly line of Oakland Drive on a radius of 195 feet for 78.28 feet (Chord 77.75 feet, N. 67deg. 50′ E.) to the point of intersection of Lots 31 and 39; thence with the dividing line between Lots 31 and 39. S. 35deg. 21′ E. 76.42 feet to the common corner of Lots 31, 33, 37, and 39; thence with the dividing line between Lots 31 and 33, S. 58deg. 49′ W. 110 feet to the point of BEGINNING.

Being the same property conveyed to Karen C. Payne by the Deed dated March 2, 1995 and recorded in Deed Book 755 at Page 436 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
